These regulations are not applicable to earthquake prevention and disaster reduction. Article 3 The term "geological environment" as mentioned in these Regulations refers to the sum of geological bodies such as rocks, soil, groundwater and their activities on the surface of the earth's crust that affect human survival and development.
The term "geological relics" as mentioned in these Regulations refers to the precious and non-renewable geological natural heritage formed during the evolution of the earth, including geological landscapes, geological sections, paleontological fossils and gem producing areas with important ornamental or scientific research value.
The term "geological disasters" as mentioned in these Regulations refers to geological phenomena that endanger people's lives and property safety, including collapse, landslide, debris flow, ground subsidence and ground fissures. Fourth people's governments at or above the county level shall strengthen the management of geological environment protection, formulate geological environment protection plans, and incorporate them into the national economic and social development plans. Fifth administrative departments of land and resources of the people's governments at or above the county level shall be responsible for the supervision and management of geological environmental protection within their respective administrative areas; Other relevant departments shall, in accordance with their respective responsibilities, do a good job in geological environment protection. Article 6 Any unit or individual shall have the obligation to protect the geological environment, and shall report to the local people's government in time when finding any abnormal geological environment; Have the right to report and accuse acts that damage the geological environment. Seventh relevant departments and scientific research institutions of the people's governments at or above the county level shall strengthen scientific research on geological environmental protection and improve the scientific and technological level of geological environmental protection. Eighth units and individuals that have made remarkable achievements in protecting and improving the geological environment and preventing geological disasters shall be commended and rewarded by the people's governments at or above the county level or the relevant departments. Chapter II Protection of Geological Environment in Mines Article 9 Units and individuals applying for mining mineral resources shall submit the geological environment impact assessment report issued by units with geological environment impact assessment qualifications to the administrative department of land and resources of the people's government at or above the county level for examination and approval. If the geological environmental impact assessment report is not approved, no mining license shall be issued.
Geological environmental impact assessment report shall be accompanied by geological environmental protection plan. Tenth geological environmental protection engineering facilities must be designed, constructed and put into use at the same time as the main project of the mine. Eleventh mining of mineral resources caused damage to the geological environment, the mining right holder shall promptly report to the administrative department of land and resources of the local people's government, and take measures to restore or control. Twelfth mining rights holders should determine the personnel responsible for the protection of mine geological environment.
The annual report on the development and utilization of mineral resources submitted by the mining right holder shall include the present situation and protection of mine geological environment. Thirteenth the implementation of mine geological environment management reserve fund system.
The reserve fund belongs to the paid mining right holder, which is stored in a special account, and is earmarked for the treatment of geological environment damage caused by the mining right holder, and shall not be used for other purposes.
Measures for the collection, use and management of reserve funds shall be formulated separately by the provincial people's government. Chapter III Protection of Geological Relics Article 14 The administrative departments of land and resources of the people's governments at or above the county level shall, jointly with relevant departments, investigate the resources of geological relics within their respective administrative areas and strengthen the supervision and management of the protection of geological relics.
The establishment of geological relics protection areas shall be carried out in accordance with the relevant provisions of the state. Fifteenth engineering facilities construction should avoid geological relics protection areas; If it is really unavoidable, it shall be examined and approved by the people's government that approved the establishment of geological relics protection zones, and measures shall be taken to protect geological relics.
The original facilities in the geological relics protection area, which are harmful to geological relics, shall be treated within a time limit; If it is not managed within the time limit or the management is not in place, it shall be dismantled within a time limit. Article 16 Mining, quarrying, earth borrowing, blasting and other activities harmful to geological relics are prohibited in geological relics protection areas. Seventeenth prohibit unauthorized collection of geological relics specimens in geological relics protection areas. If it is necessary to collect geological relic specimens for teaching and scientific research, it shall be approved by the administrative department of land and resources of the local people's government at or above the county level; Geological relics protection areas within scenic spots or forest parks shall also obtain the consent of the relevant administrative departments according to law. Eighteenth the development and utilization of geological heritage resources, should prepare a reasonable development and utilization plan, after the audit by the administrative department of land and resources of the local people's governments at or above the county level, submitted to the people's government at the same level for approval; Geological relics resources within the scenic spots or forest parks shall be approved by the relevant administrative departments and reported to the people's government at the same level for approval.
The establishment procedures of geological parks shall be implemented in accordance with the relevant provisions of the state. Chapter IV Prevention and Control of Geological Disasters Article 19 The administrative departments of land and resources of the people's governments at or above the county level shall prepare plans for prevention and control of geological disasters and annual disaster prevention plans in their respective administrative areas, which shall be implemented after being approved by the people's governments at the same level and reported to the administrative departments of land and resources of the people's governments at the next higher level for the record.
People's governments at all levels shall, according to the geological disaster prevention and control plan, arrange prevention and control funds in the financial budget for geological disaster monitoring, emergency investigation and prevention.
