Article 1 In order to improve the working system of the National Cultural Relics Appraisal Committee (hereinafter referred to as the Society) and give full play to the role of cultural relics appraisal experts in the protection and management of cultural heritage, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics and the Regulations for the Implementation of the Law of People's Republic of China (PRC) on the Protection of Cultural Relics.
The second nature and task. The Association is a cultural relic appraisal and consulting organization established in National Cultural Heritage Administration for the protection and management of cultural relics. It is composed of famous experts and scholars from cultural relics, museums and related industries hired by National Cultural Heritage Administration. Its main duties are: to identify and evaluate the historical, artistic and scientific values and grades of cultural heritage according to the needs of national cultural relics management, and to provide a basis for the collection, protection, management and implementation of relevant cultural relics protection laws and regulations.
Article 3 institutional setup. The Association has several members, including a chairman (one) and three vice-chairmen (three), all of whom are appointed by National Cultural Heritage Administration. The association will set up professional groups, and members will participate in a professional group according to their expertise, and each professional group will have a convener. The Secretariat is located in the Social Cultural Relics Department of National Cultural Heritage Administration Museum Department, with a Secretary-General, who is the head of the department. The secretariat is responsible for the daily work of the association and undertakes the task of organizing appraisal.
Article 4 Standards and Conditions. Members shall meet the following conditions:
(a) love the cause of cultural relics protection, law-abiding, with good professional ethics. Seeking truth from facts and putting national interests first;
(two) engaged in professional research of cultural relics, with many years of work experience in the corresponding field, rich experience, and outstanding achievements in the field of cultural relics research;
(3) Having senior technical positions in the fields of cultural relics and natural history or in related fields;
(4) Being in good health and able to undertake relevant work of the Association.
Article 5 methods of production. In principle, the number of members and vacancies of this association will be supplemented every two years. Candidates for membership are recommended by current members, cultural relics administrative departments of provinces, autonomous regions and municipalities directly under the Central Government and relevant industry authorities. After discussion by professional organizations, they will be submitted to the Committee for secret ballot, and will be selected in turn according to the number of votes won until the quota is full. With the consent of the newly elected members and their units or local cultural relics administrative departments, they will be reviewed and publicized by National Cultural Heritage Administration. If there is no objection, it will be publicized and a letter of appointment will be issued.
Article 6 Scope of work. (a) to provide advice for the administrative decision-making of national cultural relics protection and management;
(two) to supervise and guide the collection of national key precious cultural relics and the collection and protection of precious cultural relics in museums, provide appraisal consultation and undertake relevant research work;
(three) to participate in the identification and confirmation of first-class cultural relics in state-owned collections;
(four) entrusted by National Cultural Heritage Administration to review the conclusions of judicial expertise of cultural relics involving major criminal cases;
(five) summarize the experience of cultural relics identification, exchange academic research results, and cultivate cultural relics identification talents;
(6) Other tasks of National Cultural Heritage Administration.
Article 7 working procedures. (a) according to the needs of the work, the secretariat organizes members to carry out the work;
(two) involving major cultural relics appraisal matters, each type of cultural relics appraisal committee of not less than three people;
(three) after the completion of the work, it is necessary to submit the appraisal conclusion signed by all the members involved in the work to National Cultural Heritage Administration.
Article 8 Rights and obligations. Members enjoy the following rights:
(a) Have the right to fully express their opinions in an independent capacity without interference from any unit or individual;
(two) as a member to put forward opinions or suggestions to National Cultural Heritage Administration;
(three) to undertake the judicial appraisal of cultural relics, you can ask the relevant departments to take safety measures;
(four) to carry out the work at the request of National Cultural Heritage Administration and get the corresponding remuneration;
(five) according to personal wishes, quit the association;
(six) other rights stipulated by laws, regulations and rules.
Members shall perform the following obligations:
(a) the implementation of the "People's Republic of China (PRC) Cultural Relics Protection Law" and other relevant laws, regulations and rules;
(two) at the request of National Cultural Heritage Administration, to participate in the relevant work as a member of this association, to provide fair, objective and specific opinions, and to be responsible for their own opinions. When there may be circumstances that affect the impartiality of the appraisal conclusion, the principle of avoidance should be followed;
(three) shall not work in cultural relics auction enterprises;
(four) without the permission of National Cultural Heritage Administration, not as a member of the Association to perform the task of cultural relics identification; No appraisal certificate shall be issued in the name of a member of this Association. Individuals who have nothing to do with the National Cultural Relics Appraisal Committee shall bear their own responsibilities;
(5) Keeping work secrets;
(six) other obligations stipulated by laws, regulations and rules.
Article 9 Termination of Employment
(1) Being unable to perform relevant duties due to health reasons, age reasons or emigration for more than one year;
(2) Members of this Association violate national laws, endanger national interests, violate professional ethics and violate these Provisions. With the approval of National Cultural Heritage Administration, he can terminate his employment contract and ask him to quit the association.
Article 10 Funds. The funds needed for our activities will be allocated from the national cultural relics as planned.
Article 11 supplementary provisions. These Provisions shall come into force as of the date of promulgation, and the Regulations of the National Cultural Relics Appraisal Committee (Draft) (adopted in principle at the enlarged meeting of the Party Group of the Ministry of Culture in September/985 1 Japan) shall be abolished at the same time.
National Cultural Heritage Administration is responsible for the interpretation of these provisions.
