Procedure:
(1) The applicant submits an application to the local cultural relics administrative department, which will report it to the provincial cultural relics administrative department after preliminary examination. Application materials to be submitted by cultural relics collection units: ① Application. (2) Relevant information, including the certificate of ownership or right to use the building, the certificate of capital source or capital verification report, the catalogue of the collection and the explanation of legal sources, the outline of the exhibition, the basic information of the legal representative to be appointed and the professional and technical management personnel, and the certification materials of fire safety, etc. To apply for the establishment of a non-state-owned museum, the draft articles of association of the museum shall be submitted at the same time. (two) the provincial cultural relics administrative department for examination and approval in accordance with the law, to grant permission to meet the prescribed conditions, not to grant permission to the application that does not meet the prescribed conditions, and to inform the reasons in writing. If the name of the museum needs to be prefixed with the word "China", it shall be audited by the provincial cultural relics administrative department and submitted to the cultural relics administrative department of the State Council for examination and approval in conjunction with the office of the Central Organization Establishment Committee.
Law enforcement responsibility:
Article 76 of the Law on the Protection of Cultural Relics in People's Republic of China (PRC) stipulates that if the staff of the cultural relics administrative department violates the provisions of the Law on the Protection of Cultural Relics in People's Republic of China (PRC), abuses the examination and approval authority, fails to perform their duties or fails to investigate and deal with illegal acts, resulting in serious consequences, the responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law, and if the circumstances are serious, they shall be dismissed from public office according to law. If a crime is constituted, criminal responsibility shall be investigated according to law. A person who has been dismissed from public office shall not serve as a cultural relics manager for ten years from the date of being dismissed from public office.
