Provisions on penalties for reselling cultural relics:

1. Whoever resells cultural relics prohibited from making profits, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention and shall also be fined;

2. If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall also be fined.

Article 32 of the Law of People's Republic of China (PRC) on the Protection of Cultural Relics

Any unit or individual who finds cultural relics in construction projects and agricultural production shall protect the site and report to the local cultural relics administration department immediately. After receiving the report, if there are no special circumstances, they should rush to the scene within twenty-four hours and put forward their opinions within seven days. The administrative department of cultural relics may report to the local people's government and notify the public security organ to help protect the scene; When discovering important cultural relics, it shall immediately report to the administrative department of cultural relics in the State Council, and the administrative department of cultural relics in the State Council shall put forward handling opinions within fifteen days after receiving the report.

Cultural relics discovered in accordance with the provisions of the preceding paragraph belong to the state, and no unit or individual may plunder, privately divide or hide them.
