Regulations of Sichuan Province on Metrology Supervision and Management (revised on 20 19)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Metrology Law of People's Republic of China (PRC) and other relevant laws and regulations, and in light of the actual situation in Sichuan, with a view to strengthening the supervision and administration of metrology, ensuring the unity of national units of measurement and the accuracy and reliability of measurement values, promoting the development of production, trade, science and technology, and protecting the legitimate rights and interests of consumers, producers and operators. Article 2 All units and individuals that establish standard measuring instruments, conduct metrological verification, calibration, testing, manufacturing and repair (including transformation, the same below), install and operate measuring instruments, use measuring units, conduct metrological settlement of goods and services, and engage in other metrological activities shall abide by these regulations. Article 3 The metrological administrative department of the provincial people's government shall exercise unified supervision and management over the metrological work in the whole province.

The metrological administrative departments of local people's governments at or above the county level shall be responsible for the supervision and administration of metrological work within their respective administrative areas. Article 4 Local people's governments at all levels shall incorporate metrological work into national economic and social development plans, encourage research on metrological science and technology, and popularize advanced metrological science and technology and management methods.

Units and individuals that have made remarkable achievements in measurement work shall be commended or rewarded. Chapter II Units of Measurement Article 5 International units of measurement and other units of measurement selected by the state shall be the national legal units of measurement. The names and symbols of the national legal units of measurement shall be implemented according to the announcement of the State Council.

All activities involving measurement should use the national legal units of measurement. Article 6 To engage in the following activities, the national legal units of measurement must be used:

(1) Making official documents, bulletins and statistical statements;

(2) producing and broadcasting radio and television programs;

(3) publishing reports and academic papers;

(4) Making and publishing advertisements;

(5) Publishing books, newspapers and audio-visual products;

(6) Printing bills, vouchers and account books;

(seven) to formulate standards, verification procedures, technical specifications and product specifications;

(eight) issued by the inspection and inspection data;

(nine) the production and operation of goods, marked with commodity identification;

(ten) other activities to indicate the unit of measurement for the society. Article 7 Illegal units of measurement such as import and export commodities, publication of ancient books and literary books shall be implemented in accordance with relevant state regulations. Chapter III Measuring Instruments Article 8 Units and individuals that manufacture or repair measuring instruments shall have production facilities, inspection conditions and technical personnel that meet the requirements of the state and meet the safety requirements. Article 9 The finalization and appraisal of new measuring instruments shall be carried out by the metrological verification institutions authorized by the metrological administrative department of the State Council; The type of new measuring instruments shall be approved by the metrological administrative department of the provincial people's government; The prototype test of new measuring instruments shall be carried out by the metrological verification institution authorized by the metrological administrative department of the provincial people's government. Article 10 It is forbidden to manufacture, operate, repair or install the following measuring instruments:

(a) the production and use of which are explicitly prohibited by the state;

(two) there is no seal or certificate for verification and calibration;

(3) Assemble with defective parts. Eleventh the use of measuring instruments shall not have the following acts:

(a) damage the accuracy of measuring instruments;

(2) practicing fraud;

(3) destroying the seal of metrological verification;

(four) the use of measuring instruments that exceed the verification and calibration period or fail to pass the verification and calibration;

(five) the use of measuring instruments prohibited by the state. Chapter IV Metrological Verification and Metrological Verification Article 12 The highest standard instruments of measurement established by each unit shall hold the verification certificate issued by the metrological administrative department according to law. Thirteenth statutory metrological verification institutions and metrological verification and calibration institutions authorized by the metrological administrative department of the local people's governments at or above the county level (hereinafter referred to as metrological verification institutions) must meet the following requirements for verification, calibration and testing of measuring instruments:

(1) The standard instruments of measurement used have verification certificates issued by the metrological administrative department of the local people's government at or above the county level;

(2) Projects within the area and scope specified by the metrological administrative department of the local people's government at or above the county level;

(3) Implementing corresponding metrological verification regulations and calibration methods;

(four) the metrological verification personnel must pass the examination. Fourteenth metrological verification institutions shall complete the verification and calibration work within 20 days after receiving the measuring instruments under inspection. If it is necessary to extend the verification and calibration time due to special circumstances, it shall be determined by the metrological verification institution and the inspection unit through consultation. Article 15 The seals and certificate marks used for verification and calibration of measuring instruments shall be printed in accordance with state regulations, and the metrological administrative department of the local people's government at or above the county level shall be responsible for the management. No unit or individual may make or forge, steal or resell seals and certificate marks of measuring instruments without authorization. Article 16 Units or individuals that use working measuring instruments that are subject to compulsory verification as stipulated by the state must report the verification of working measuring instruments that are subject to compulsory verification to the metrological administrative department every year, and apply to the designated metrological verification institution for periodic verification.

The metrological verification institution shall regularly report the verification of measuring instruments to the metrological administrative department for the record. Article 17 New products of measuring instruments involving human health, safety protection, handover of important commodities and bulk materials, determination of legal liability or closely related to consumers' interests shall be listed by the metrological administrative department of the provincial people's government and submitted to the provincial people's government for approval before they can be included in the scope of compulsory verification.
