Measures of Luoyang Municipality on the Protection and Management of the Grand Canal Heritage

Article 1 In order to strengthen the effective protection and scientific utilization of the Grand Canal heritage, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) Municipality on the Protection of Cultural Relics and the Regulations of Luoyang Municipality on the Protection of Sui and Tang Sites, and in combination with the present situation of the Grand Canal heritage protection and the actual situation of this Municipality. Article 2 The Grand Canal heritage as mentioned in these Measures includes storage relics, bridges, rivers, hydraulic relics and various related historical relics and cultural landscapes closely related to Luoyang section of the Sui and Tang Dynasties Grand Canal. Article 3 The protection of the Grand Canal heritage shall adhere to the principles of unified planning, effective protection and rational utilization, and ensure the authenticity and integrity of the Grand Canal heritage, historical features and natural environment. Article 4 The Municipal People's Government shall strengthen its leadership in the protection of the Grand Canal heritage. The municipal administrative department of cultural relics is the administrative department in charge of the heritage protection of the Grand Canal, and the relevant departments of planning, construction, land, environmental protection and water affairs are responsible for the heritage protection of the Grand Canal within their respective functions and duties.

The people's governments at the county level where the Grand Canal heritage is located shall cooperate with the protection of the Grand Canal heritage within their respective administrative areas. Article 5 The important heritage of the Grand Canal includes:

(1) Including the Jiacang site;

(2) Back to Luocang site;

(three) according to the census registration, scientific research or archaeological excavations, and other important cultural relics identified by the cultural relics department according to law. Article 6 The protection scope and construction control zone of the important heritage of the Grand Canal are:

(1) Including the protection scope of Jiacang Site: east to the north-south line of Pingping Street, south to Zhongzhou Canal, west to the north extension line of Huancheng West Road, and north to the east-west line 200 meters north of Chundu Road.

(2) Protection scope of Huiluocang site: north to the north wall of Haig Refractory Factory, east to the west wall of Xiaolicun 100 m, south to the national highway 3 10 200 m, and west to the west wall of Haig Refractory Factory.

The boundary line of the protection scope extends to the surrounding 100 meters as the construction control zone.

According to archaeological discoveries or research results, important sites should be supplemented in time according to law. If the protection scope and construction control zone of the important heritage of the Grand Canal are redefined according to law, the new regulations shall apply. Article 7 The Municipal People's Government shall include the Grand Canal heritage protection funds into the fiscal budget at the corresponding level, and increase with the growth of fiscal revenue; Encourage citizens, legal persons and other organizations to make voluntary donations for the heritage protection of the Grand Canal; The Grand Canal heritage protection funds shall be earmarked and shall not be withheld or misappropriated, and shall be subject to the supervision of the municipal finance and auditing departments. Article 8 Citizens, legal persons and other organizations have the obligation to protect the heritage of the Grand Canal according to law. Have the right to stop and report acts that destroy the heritage of the Grand Canal and its historical features. Units or individuals that have made remarkable achievements in protecting the heritage of the Grand Canal shall be commended and rewarded. Article 9 The heritage protection plan of the Grand Canal shall be formulated by the municipal cultural relics administrative department jointly with relevant departments according to the needs of heritage protection, and approved and promulgated by the Municipal People's Government.

The people's government where the heritage is located shall formulate plans for national economic and social development, overall land use planning, urban and rural construction, water conservancy and environmental protection. In this administrative area, we should coordinate with them. Article 10 The Municipal People's Government shall attach importance to the investigation and archaeological excavation of the Grand Canal heritage, scientifically formulate protection and exhibition plans, and build the heritage with outstanding value and perfect functions into tourist areas or ruins museums. Eleventh the following acts are prohibited within the scope of the important heritage of the Grand Canal:

(1) Shooting areas or cultural relics with signs prohibiting shooting;

(two) daub, depict, climb and post on the buildings and structures of cultural relics;

(three) illegal dumping, piling up garbage, sewage and drainage;

(4) repairing tombs and erecting monuments;

(5) Building houses, building kilns, drilling wells, digging ponds, digging pits, digging canals, taking soil, reclaiming land, etc. Unauthorized;

(six) storage of flammable, explosive, corrosive and other items that endanger the safety of the site;

(seven) unauthorized collection of cultural relics;

(eight) other acts that endanger the safety of the website. Article 12 Within the scope of the protection of the important heritage of the Grand Canal, no engineering construction, blasting, drilling, excavation or other operations unrelated to the protection of the site may be carried out. If it is really necessary to carry out the project construction, it shall conform to the Luoyang Grand Canal heritage protection plan and go through the examination and approval procedures according to law. Thirteenth construction in the important heritage control area of the Grand Canal shall conform to the Luoyang Grand Canal heritage protection plan, and shall not destroy the environmental landscape and historical features of the Grand Canal heritage. Fourteenth in violation of these measures, one of the following acts, the municipal administrative department of cultural relics shall be ordered to make corrections, if the circumstances are serious, shall be punished according to the following provisions:

(a) in violation of the provisions of article eleventh (a) and (two), a fine of 200 yuan; In violation of the provisions of article eleventh (three) and (four), a fine of more than 2000 yuan shall be imposed on 500 yuan; In violation of the provisions of Item (5) and Item (6) of Article 11, a fine of more than 2000 yuan 10000 yuan shall be imposed; In violation of the provisions of article eleventh (seven), a fine of 5000 yuan or more and 50000 yuan or less shall be imposed.

(2) Whoever, in violation of the provisions of Article 12, carries out engineering construction or blasting, drilling, excavation and other operations unrelated to the protection of the site within the scope of the Grand Canal heritage, endangering the safety of the site and causing damage to the ontology and historical features of the Grand Canal heritage, shall be fined between 50,000 yuan and 500,000 yuan.

(three) in violation of the provisions of article thirteenth, in the construction control zone, the project design did not go through the examination and approval procedures, resulting in the destruction of the Grand Canal heritage ontology and historical features, a fine of 50 thousand yuan and 500 thousand yuan.

In violation of these measures, the site and its protection facilities are damaged, and the losses shall be compensated. If the project construction causes damage to the heritage ontology and historical features of the Grand Canal, it shall be ordered to dismantle illegal buildings or structures, restore the site to its original state, and give administrative sanctions to the relevant responsible persons; If a crime is constituted, criminal responsibility shall be investigated according to law.
