How to determine the crime of spreading obscene articles, how to punish it and how many years to sentence it?

The crime of spreading obscene articles and the crime of spreading obscene articles for profit are two independent crimes. Whoever disseminates obscene articles for profit shall be sentenced to fixed-term imprisonment of not more than two years, criminal detention or public surveillance. Whoever disseminates obscene articles to minors under the age of 18 shall be given a heavier punishment. Spreading obscene books, periodicals, films, audio-visual images, pictures or other obscene articles, if it is suspected of one of the following circumstances, shall be filed for prosecution: (1) Spreading to others for more than 300 times and less than 600 times; (2) Causing adverse social impact.
