Toxic and harmful chemical operations are one of the characteristics of chemical production. There are obvious differences in working conditions and remuneration between workers engaged in toxic and harmful operations and workers engaged in non-toxic and harmless operations. In order to give necessary compensation for the special labor consumption of chemical production workers, further implement the principle of distribution according to work, and stabilize the first-line team, this implementation opinion is formulated according to the requirements of the Notice on Establishing the Post Allowance System for Toxic and Hazardous Chemical Operations jointly issued by the Ministry of Labor and the Ministry of Finance.

First, the scope of implementation of post allowance for toxic and harmful operations in chemical industry

1. In principle, it shall be implemented in accordance with the Work Scope Table of Toxic and Hazardous Operations No.738 of the Ministry of Chemical Industry and the Supplementary Work Scope Table of Toxic and Hazardous Operations No.923 of the Ministry of Chemical Industry, that is, the front-line workers who are directly engaged in toxic and hazardous operations in chemical industry all the year round are the main targets of the allowance.

2. Where new products and new jobs (posts) are not included in the scope, enterprises can apply according to the relevant national standards, report them to the chemical department (company) of the province, autonomous region or municipality directly under the Central Government for examination and approval, and report them to the Ministry for filing before implementation.

3. Full-time safety officers, analysts, laboratory technicians, maintenance workers and workshop production management personnel in the production process should enjoy allowances lower than the standards of production workers in the corresponding positions.

4. Chemical anticorrosion workers, waste disposal workers and toxic materials storage and transportation workers can enjoy the post allowance for toxic and harmful chemical operations according to the actual situation.

5. In chemical production, other work such as chemical dust, underground work in chemical mines, high temperature and high altitude, especially heavy manual labor, etc. Directly engaged in all the year round, according to the relevant national standards and with reference to the relevant subsidies of other industries.

Two. Classification and standard of allowances

The post allowance for toxic and harmful operations in chemical industry is divided into four grades.

In principle, the classification of post allowance is based on the national standard of Classification of Toxic Operations (GB12331-90+0-90), that is, it is divided into four grades: A, B, C and D according to the toxicity of productive poisons, the concentration of poisons in the working environment exceeds the standard, the working hours of toxic operations and the actual harm of poisons to human health. The hazard degree of productive poisons should be determined according to the national standard "Classification of Hazard Degree of Occupational Exposure Poisons" (GB 5044-85).

All jobs that are exposed to accumulated poisons and are extremely harmful to human body, organs, blood and nervous system are classified as Class A;

All jobs that are exposed to accumulated toxic substances, but with good working conditions, small dosage or less toxicity, which are harmful to human body, are rated as Grade B;

Any work that comes into contact with irritating poisons, has harsh working conditions and causes moderate harm to human body is rated as Grade C;

Any work that comes into contact with irritating poisons, has low toxicity, poor working conditions, and has slight harm to human body is rated as D. ..

The standard of daily allowance for each grade is:

Class A is extremely harmful, 2.0 yuan

Class b high risk 1.5 yuan.

Class C moderate hazard 1.2 yuan

Ding and other minor hazards are 0.9 yuan.

When determining the post allowance level for toxic and harmful chemical operations, all units should combine the post labor evaluation.

Three. Sources of subsidy funds

The post allowance for toxic and harmful operations in chemical industry is a kind of salary compensation for employees who directly engage in toxic and harmful operations all the year round. The allowance is paid under the wage fund and included in the production cost.

Enterprises whose total wages are linked to economic benefits can be improved in total wage base.

Four. Payment and management of allowances

1. The post allowance for toxic and hazardous operations in chemical industry is calculated according to the number of days actually engaged in toxic and hazardous operations and paid monthly.

2. If the process and equipment are improved or the working conditions of toxic and harmful operations are improved through treatment, the post allowance shall be re-approved and adjusted according to the new situation.

3 enterprises that implement post allowance for toxic and harmful chemical operations should strengthen health monitoring of workers and establish and improve workers' health records.

4. All units should combine the establishment of post allowance system, rectify labor organizations, strictly set quotas, and establish and improve post responsibility system.

5 enterprises that implement the post allowance for toxic and harmful operations should combine the increased total allowance with the post skill wage pilot and the internal distribution reform of enterprises, and make independent arrangements by enterprises.

6. As a kind of salary, the post allowance for toxic and harmful chemical operations is an integral part of salary and should be included in the calculation base of retirement fee. Now some provinces and cities have policies to solve this problem, and enterprises handle it according to local regulations; Other unresolved provinces and cities should create conditions and actively strive for an early settlement.

7. The operating mechanism should be established for the post allowance of toxic and harmful chemicals. With the improvement of allowance standard and the adjustment of scope and grade, the total amount of allowance will change accordingly, and it will be linked to cost and work efficiency in time when it enters total wage base.

This implementation opinion has been implemented since February 1993. Provinces and cities can formulate detailed rules for implementation according to the actual situation in the region. For enterprises that have established a subsidy system, the time to raise the subsidy standard is still implemented according to the provisions of document No.43 [1992], and can also be determined according to the reform arrangement of enterprise wage system.
