Provisions of Shaanxi Province on the Administration of Cultural Relics Reproduction

Article 1 In order to strengthen the management of reproduction, production and sales of cultural relics in our province, ensure the quality of cultural relics and maintain the reputation of production and sales of cultural relics, these Provisions are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Protection of Cultural Relics and the Regulations of Shaanxi Province on the Protection and Management of Cultural Relics. Article 2 The reproduction and unification of cultural relics shall be managed by the provincial cultural relics administrative department. The reproduction of first-class cultural relics shall be audited by the provincial cultural relics administrative department and reported to the state cultural relics administrative department for examination and approval; The reproduction of cultural relics below grade two (including grade two) shall be examined and approved by the provincial cultural relics administrative department. Article 3 Replicas of cultural relics refer to special commodities that are basically the same as the original cultural relics made by the producers of cultural relics according to their size, shape, color, decoration, weight and texture. The reproduction of some special cultural relics, with the approval of the provincial cultural relics administrative department, can be made of materials different from the original cultural relics. Article 4 Reproduction of cultural relics shall be carried out at designated production sites. Cultural relics reproduction production units shall be examined and approved by the provincial cultural relics administrative department, issue a cultural relics reproduction appraisal certificate, apply for registration with the local administrative department for industry and commerce, and obtain a business license. Article 5 The reproduction and production of cultural relics shall follow the principle of few but fine. Designated production units shall put forward a production plan for reproduction of cultural relics, report it to the provincial cultural relics administrative department for approval, and issue the production serial number. Production units and cultural relics collection units shall sign a contract before they can carry out production. Article 6 An entity applying for reproduction and production of cultural relics must meet the following conditions:

(1) Having an independent enterprise legal person qualification.

(2) Having the production site, process equipment, professional technical force and means of quality supervision and inspection necessary for the reproduction of cultural relics.

(3) Holding the approval document of the superior competent department. Seventh cultural relics reproduction units shall enjoy the reproduction and production of cultural relics within the scope of approval and other rights stipulated by national laws and regulations. Eighth cultural relics reproduction production units must fulfill the following obligations:

(1) Reproduction and production of cultural relics within the approved scope;

(two) according to the provisions of the registration, pay taxes;

(3) The plan for reproduction of cultural relics shall specify the name, grade, texture, shape, unearthed place and collection unit of the copied cultural relics;

(four) the reproduction of cultural relics must ensure the absolute safety of cultural relics, and shall not damage the original value of cultural relics;

(five) to perform other obligations related to the reproduction of cultural relics. Ninth cultural relics reproduction production units in case of production location, project changes, etc. , should be within three months to the provincial administrative department of cultural relics and the local administrative department for Industry and commerce to apply for registration of change. Tenth some precious cultural relics with high historical and scientific value and unique artistic style shall not be directly copied on the original cultural relics.

No unit or individual may reproduce cultural relics by using replicas. Eleventh cultural relics reproduction production quality supervision, commissioned by the provincial technical supervision bureau of the relevant quality inspection station. Twelfth copies of cultural relics must be marked with the name, year, reproduction unit, time, quantity and secret. Small replicas of cultural relics can be marked with stars for inspection by industrial and commercial administration, customs, railways and other departments. Thirteenth cultural relics collection and storage units and their staff shall not provide samples, molds and related professional and technical information to any unit or individual. Fourteenth copies of cultural relics should be sold at designated points. Any unit or individual who distributes cultural relics shall apply to the provincial cultural relics administrative department for obtaining the License for Reproduction and Sales of Cultural Relics, and apply to the local administrative department for industry and commerce for a business license before distributing cultural relics. Article 15 When selling cultural relics replicas to organizations or individuals in foreign countries, Hong Kong, Macao and Taiwan, business units of cultural relics replicas shall fill in the name, texture, specifications and number of pieces of cultural relics replicas on the special invoices for the sale of cultural relics replicas, and indicate them as replicas.

The sales of replicas should be clearly marked. Article 16 The imitation of particularly precious cultural relics shall be managed in accordance with the Regulations on the Reproduction of Cultural Relics. Seventeenth one of the following acts, by the local administrative department for Industry and commerce according to the circumstances, given administrative punishment.

(1) Reproduction, production or sale of cultural relics without approval;

(2) Selling, transferring or forging a license for reproduction of cultural relics or a license for sale of cultural relics for reproduction or sale of cultural relics;

(3) For the purpose of copying cultural relics, without permission, the collection and storage units of cultural relics and their staff provide samples, technical data and molds of cultural relics or related cultural relics to any unit or individual;

(four) non cultural relics reproduction production units or individuals using cultural relics for reproduction;

(five) other acts in violation of the provisions.

Violation of the above-mentioned regulations on the management of cultural relics reproduction, which constitutes a crime, shall be transferred to judicial organs for criminal responsibility according to law. Eighteenth the provisions shall come into force as of the date of promulgation, and the provincial cultural relics administrative department shall be responsible for the interpretation.
