Provisions of Hainan Special Economic Zone on Safety Management of Ferry

Article 1 In order to strengthen ferry management, maintain ferry order and ensure the safety of people's lives and property, these Provisions are formulated in accordance with the People's Republic of China (PRC) Maritime Traffic Safety Law, the People's Republic of China (PRC) Inland River Traffic Safety Management Regulations and other relevant laws and regulations, combined with the actual situation of this province. Article 2 Units and individuals related to ferries and ferry activities in Hainan Special Economic Zone shall abide by these Provisions.

The ferry mentioned in these Provisions refers to the places and facilities for ferrying people, vehicles and goods between rivers, lakes, reservoirs, ports and Hainan Island and offshore islands in Hainan Special Economic Zone, including docks, waters and other facilities providing ferrying services. Article 3 The people's governments of provinces, cities, counties and autonomous counties shall strengthen the organization and leadership of ferry management within their respective administrative areas and establish and improve the responsibility system for ferry safety management.

The traffic administrative department of the provincial people's government is responsible for the safety supervision and guidance of the ferry and ferry industry; The traffic administrative departments of the people's governments of cities, counties and autonomous counties shall be responsible for the specific supervision and management of ferry and ferry transportation.

The maritime administrative agency shall be responsible for the supervision and administration of water traffic safety at the ferry.

The safety production supervision and management departments of the people's governments of provinces, cities, counties and autonomous counties shall implement comprehensive supervision and management of ferry safety work. Article 4 Township People's governments shall implement the responsibility system for ferry safety management, designate or employ ferry managers to be responsible for the on-site supervision and management of ferry, and perform the following duties:

(a) to publicize the laws and regulations on water traffic safety;

(2) To be responsible for the safety supervision and inspection of ferries and ferry sites, promptly correct acts endangering safety and report to relevant departments and maritime administrative agencies;

(three) to cooperate with the relevant departments to investigate and deal with the water traffic accidents at the ferry;

(four) organize the ferry crew to participate in relevant training and examinations. Article 5 Ferry managers and operators (hereinafter referred to as ferry operators) shall implement the main responsibility of production safety, establish and improve the ferry safety management system, and ensure the safety of the ferry. Article 6 The people's governments of provinces, cities, counties and autonomous counties shall incorporate ferry safety management into the annual assessment of production safety responsibility targets of the government at the next lower level and the relevant departments of the government at the same level. Article 7 The people's governments of cities, counties and autonomous counties shall increase investment in ferry construction, incorporate the related construction and management expenses of the ferry into the fiscal budget, and improve the supporting facilities and equipment for ferry safety.

The people's governments of cities, counties and autonomous counties shall incorporate the public welfare ferry service into the catalogue for guiding the government to purchase services, and the required funds shall be included in the fiscal budget and make overall arrangements. Article 8 The people's governments of cities, counties and autonomous counties shall organize relevant departments to make unified planning for ferries within their respective administrative areas, and incorporate ferry construction into the scope of rural highway construction. Article 9 The establishment and cancellation of a ferry shall be approved by the people's government of the city, county or autonomous county where the ferry is located. The people's governments of cities, counties and autonomous counties shall solicit the opinions of the maritime administrative agency before examination and approval. Where a ferry is set up within the scope of management of rivers, lakes and reservoirs, the opinions of the water administrative department shall also be sought.

The establishment and revocation of cross-administrative ferries shall be handled by the people's governments of cities, counties and autonomous counties across administrative regions through consultation; If negotiation fails, it shall be submitted to the people's government at the next higher level for decision.

It is strictly forbidden to set up and cancel the ferry without authorization. Article 10 The specific standards for ferry construction shall be formulated by the provincial standardization administrative department in conjunction with the relevant departments of commerce, transportation, maritime affairs and water affairs in combination with the actual situation of the province's waters, ferry capacity and functions.

After the completion of the ferry construction, the people's government of the city, county and autonomous county where the ferry is located shall organize the relevant departments of transportation, maritime affairs and water affairs to pass the inspection before it can be put into operation. Article 11 A ferry shall be equipped with safety facilities for loading and unloading goods and getting on and off passengers, and necessary life-saving and fire-fighting equipment.

A ferry engaged in night ferry service shall be equipped with necessary lighting equipment. Article 12 The ferry operator shall set up a bulletin board in a prominent position, indicating the name of the ferry, the ferry area, the ferry route, the ferry code, the safety precautions, the safety responsible unit and person, the supervision and rescue telephone number and other contents.

Ferry operation shall comply with the provisions of the state and the province on environmental protection, and shall not pollute the environment. Thirteenth ferry shall meet the following conditions:

(1) Holding valid ship registration certificate and ship inspection certificate;

(two) equipped with ferry crew who have obtained the ferry crew certificate according to law;

(three) equipped with necessary life-saving and fire-fighting equipment;

(four) other conditions stipulated by laws, regulations and rules.

Rafts, agricultural vessels, fishing vessels or scrapped vessels are prohibited from engaging in ferry transportation.

Ferry night flight shall be equipped with night flight equipment in accordance with relevant regulations. Article 14 The ferry shall be equipped with identification signs that meet the requirements of the state, and the passenger quota, wind resistance grade and safety precautions shall be marked in obvious positions.

The ferry shall be maintained regularly to ensure its seaworthiness and apply for inspection on schedule; Those who fail to inspect or fail to pass the inspection within the time limit shall not engage in ferry transportation. Fifteenth ferry crew shall meet the following conditions:

Eighteen to sixty-five years old;

(2) Being in good health and familiar with water conditions;

(3) Possessing ship handling skills and being familiar with ferry waters;

(four) skilled use of various life-saving and fire-fighting equipment equipped at the ferry.

Those who meet the above conditions can drive the ferry only after passing the examination by the maritime administrative agency and obtaining the ferry crew certificate.

After the ferry crew has reached the age of 65, its ferry crew certificate will be automatically cancelled.

Ferry crew members shall participate in safety training organized by the relevant competent departments or township people's governments every year.
