Transformation and rule of law
China is a big country in transition, so it is difficult to compare the transitional rule of law with the conventional rule of law. Social transformation has many meanings, which can refer to system transformation, that is, the transformation from planned economy system to market economy system, that is, the rise of capitalism and the expansion of market economy; It can also refer to the transformation of social structure, that is, the structural state transformation of the whole society, including changes in people's behavior, lifestyle, psychological state, value system, etc. It can also refer to the change of social form, that is, the change of China society from traditional to modern, from agriculture to industry, from rural to urban, and from closed to open. These changes and transformations put forward requirements for the rule of law. For example, the transition from rural areas to cities and from closed to open means that local rules, customs, habits and even languages will gradually disintegrate or even disappear, people will gradually be liberated from various local constraints and directly face the norms of national rules, so local society will gradually be brought into the process of national unity and rule of law.
On the one hand, the rule of law in China's social transition period can be used for reference by predecessors. The social transformation that China is experiencing today is experienced by western developed countries in many aspects, such as social form and social structure, so the western experience can be used for reference. For example, developed countries in Europe and America have basically experienced the transformation from an agricultural society to an industrial society since modern times, and then entered the process of globalization. Corresponding to this process, the development of the rule of law has formed a relatively stable system.
On the other hand, China's social transition period has its uniqueness and uncertainty, which is not found in the historical experience of western countries. The modernization of 654.38+0.3 billion people and its related social transformation took place in such a short time, which is unprecedented in human history. China's social transformation for decades is equivalent to that of Europe and America for two or three hundred years, and the population of China is more than that of developed countries in Europe and America combined. At present, China's economic and social development is in good condition and its prospects are very optimistic, but uncertainties still exist. At what level and height will China's economic and social development form a relatively balanced and stable state, which depends on many factors, not limited to domestic factors. In other words, the social state after the transformation is not only decided by China himself. Therefore, there may be some ambiguity in the goal of rule of law in transition. If it is difficult for us to fully determine the social state after the transformation, it will be difficult to establish a clear rule of law that meets the needs of society.
With the rapid development in the past few decades, the achievements of urbanization are still limited. Can China embark on the urbanization road like Europe and America and basically eliminate the countryside? How long does this road take? These are all questionable. In this unpredictable situation, there must be many uncertainties in building a society ruled by law. The economic base determines the superstructure. As a superstructure, the rule of law is deeply dependent on the social state and nature, and at the same time it must be predictable and advanced. However, the uncertainty of China's economic base transformation makes the rule of law arrangement even more uncertain.
