Regulations of Fushun Municipality on the Protection of Rights and Interests of the Elderly

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly and in light of the actual situation of this Municipality in order to protect the legitimate rights and interests of the elderly and develop their undertakings. Article 2 These Regulations shall apply to all state organs, social organizations, enterprises, institutions and individuals within their respective administrative areas. Article 3 The term "old people" as mentioned in these Regulations refers to citizens over the age of 60. Article 4 The people's governments of cities and counties (districts) shall be responsible for the management of the protection of the rights and interests of the elderly and organize the implementation of these Regulations.

City, county (District) agencies responsible for the coordination, guidance, supervision and inspection of the specific work of the protection of the rights and interests of the elderly. State organs, social organizations, enterprises and institutions shall, in accordance with their respective responsibilities, do a good job in safeguarding the rights and interests of the elderly. Article 5 The people's governments of cities and counties (districts) shall incorporate the cause of aging into local economic and social development plans, gradually increase investment in the cause of aging, and promote the coordinated development of the cause of aging and building a well-off society in an all-round way. Article 6 The lawful rights and interests of the elderly in politics, economy, culture, society, marriage and family life, national customs and religious beliefs are protected by law, and no unit, organization or individual may infringe upon them.

Discrimination, insult, abuse or abandonment of the elderly are prohibited. Seventh city and county (District) people's governments shall commend or reward organizations, families or individuals that have made outstanding contributions to social development. Chapter ii family security article 8 legitimate children, illegitimate children, adopted children and stepchildren who have formed a maintenance relationship with the elderly have the obligation to support the elderly. If the children of the elderly have died or their children are unable to support them, the grandchildren who have the ability to support them have the obligation to support them. The spouse of the supporter shall assist the supporter in fulfilling his maintenance obligations.

The elderly have the right to request to sign a family support agreement with their children or a legacy support agreement with others. Ninth elderly people have the right to use, benefit and dispose of personal property according to law, and children or other relatives may not interfere. The elderly have the right to refuse financial assistance from adult children who have the ability to live independently. Adult children are not allowed to extort property from the elderly because of unemployment or other reasons.

No one may interfere with the notarization of property before the elderly remarry. Article 10 Children or other relatives shall respect the marital autonomy enjoyed by the elderly according to law. Shall not interfere with the divorce, remarriage and married life of the elderly. The legal residence right of the elderly is not deprived or restricted because of the change of marriage relationship.

The maintenance obligation of the supporter is not eliminated by the change of the marital relationship of the elderly. Article 11 Supporters have the obligation to protect the elderly and improve their living conditions, and may not force them to move to houses with poor conditions.

The elderly and their children or other relatives * * * own the houses purchased and built, and the elderly should enjoy the corresponding share of housing ownership.

Children or other relatives shall not occupy the housing owned or leased by the elderly, and shall not change the property right relationship or lease relationship without authorization; Real estate, land and resources, notarization and other departments shall obtain the consent and signature of the elderly when handling the procedures for the change of house ownership or lease. Chapter III Social Security Article 12 The people's governments of cities and counties (districts) shall include the funds for the development of undertakings for the aged in the annual financial budget. A certain proportion of the proceeds from welfare and sports lottery should be used to develop welfare undertakings for the elderly and carry out sports activities for the elderly. Article 13 Pensions and other benefits enjoyed by the elderly according to law shall be guaranteed, and social insurance agencies or relevant units shall pay them in full and on time. Fourteenth city and county (District) people's governments shall, according to the level of economic development, gradually establish rural social endowment insurance system, collective pension allowance distribution system and new cooperative medical system. Article 15 If the elderly who have no ability to work, no source of income, no supporter or supporter are urban residents, the county (district) civil affairs department shall issue them living expenses higher than the minimum living guarantee standard for urban residents or be supported by the old-age service institutions; Belonging to rural residents, the township (town) people's government shall organize centralized support, or implement decentralized support to households to ensure their basic livelihood. Sixteenth city and county (District) people's governments should carry out various forms of relief activities for the elderly with difficulties in life. Seventeenth city and county (District) people's governments should gradually establish and improve the medical care service system for the elderly based on community health services. Community health service stations provide prevention, health care, medical treatment, nursing and rehabilitation services for the elderly. Family beds can be set up for the disabled and sick elderly to seek medical treatment, and itinerant medical treatment can be carried out.

Encourage medical institutions to carry out free clinic activities for the elderly. Article 18 Youth organizations and schools shall provide legal education for young people to safeguard the legitimate rights and interests of the elderly and moral education for respecting and helping the elderly, and organize and participate in activities for the elderly.

Newspapers, radio, television and other news media should actively carry out the propaganda of respecting, supporting and helping the elderly, and set up columns and special programs for the elderly. Nineteenth elderly people over the age of seventy can enjoy the following preferential treatment within their respective administrative areas with the "Senior Citizen's Preferential Card":

(a) free ride on city buses and electric trains;

(two) in the hospital affiliated to the Health Department or the old unit hospital, free of general outpatient registration fee;

(3) Parks and tourist attractions are free or preferential for the elderly;

(four) in theaters, clubs, cultural palace to watch movies (except special performances), you can buy tickets at half price;

(five) free to visit all kinds of art exhibitions, photography exhibitions, calligraphy exhibitions and cultural relics exhibitions;

(6) Free use of toll toilets.
