Is the workers’ compensation agreement legally binding?

A work injury compensation agreement is valid as long as it meets the conditions of the true intentions of both parties and does not violate legal provisions. The employer shall pay the following work-related injury insurance benefits after the occurrence of a work-related injury: monthly disability allowances for Level 5 and Level 6 disabled employees; wages and benefits during the treatment of work-related injuries; and one-time injury benefits when the labor contract is terminated or terminated. Legal Basis

Article 39 of the "Social Insurance Law of the People's Republic of China"

The following expenses incurred due to work-related injuries shall be paid in accordance with national regulations. The employer pays:

(1) Wages and benefits during the treatment of work-related injuries;

(2) Monthly disability allowances received by employees with level five and level six disabilities;

(3) The one-time disability employment subsidy that should be enjoyed when the labor contract is terminated or terminated.
