What is copyright?

Copyright, also known as copyright, refers to the exclusive rights enjoyed by authors over the literary, artistic, scientific and technical works they create. Copyright is a civil right enjoyed by citizens and legal persons in accordance with the law and is an intangible property right.

The earliest origin in China

The earliest use of the word "copyright" in Chinese began with China's first copyright law, the "Copyright Law of the Qing Dynasty" 》. The Qing government explained: "There are laws that are not called copyright laws but are called copyright laws. They cover more copyrights than licenses, and the protected persons are the publishers, not the creators of the publications; and they mostly refer to books and pictures, not to the creators of the publications. It is used for intricately engraved models and other artistic objects, so it is appropriate to call it a copyright.”

China’s copyright laws have continued to use this name since then. Today, Chinese society usually still uses the term copyright, but both mainland China and Taiwan no longer use copyright as the official name for rights related to works.

Within the territory of the People's Republic of China, all works by Chinese citizens, legal persons or unincorporated entities enjoy copyright regardless of whether they are published; works by foreigners first published within the territory of China shall also be protected by copyright. Copyright shall be enjoyed by law; works published by foreigners outside China shall enjoy copyright according to the agreement signed between their country and China or international treaties to which the country is a party.
