Anyone who participates in the following scientific and technological activities must conduct a confidentiality review in advance.
(a) to participate in various scientific and technological exhibitions held abroad (including industrial exhibitions involving scientific and technological contents, the same below), trade fairs and scientific and technological performances;
(two) to participate in various scientific and technological exhibitions, expositions, scientific and technological performances held in China, and to receive foreign guests to participate in and visit;
(three) to participate in various forms of international scientific and technological exhibitions, expositions and scientific and technological performances held at home and abroad. Article 3 Basis and principles of confidentiality review
(1) The basis for the confidentiality review is the Law of People's Republic of China (PRC) on Guarding State Secrets, the Regulations on Science and Technology Secrecy, the Notice of the State Science and Technology Secrecy Office on Science and Technology Secrecy Review of Foreign-related Science and Technology Exhibitions, Expositions and Science and Technology Performances and the Detailed Rules on Science and Technology Secrecy of the Ministry of Posts and Telecommunications.
(2) the principle of confidentiality review
Any scientific and technological project that may cause one of the following consequences due to an exhibition or performance shall not participate in the exhibition or performance:
1. After the exhibition, it may be obtained by other countries for military purposes and affect national security;
2. The exhibition will damage the national reputation and image;
3. After the exhibition, China's leading position in its technical field was lost or weakened, which affected the national scientific and technological advantages and strength;
4. After the exhibition, it affects the international competitiveness of its technology and its products and seriously damages the national economic interests;
5. The technology comes from special channels, which may cause international disputes or affect the security of China's scientific and technological information channels after the exhibition. Article 4 The Science and Technology Department of the Ministry of Posts and Telecommunications is responsible for the confidentiality review and approval of foreign-related scientific and technological exhibitions, expositions and scientific and technological performances, and forms a confidentiality review team together with the Foreign Affairs Department, the Office of the Ministry Security Committee and other relevant units to review and approve the documents stamped with the seal of the Office of the Ministry Security Committee. Article 5 Examination and approval procedures
(1) All participating project units (or project organizers) shall fill in the Application Form for Science and Technology Confidentiality Review of Foreign-related Participating Technology Projects in advance, and report it to the Science and Technology Department of the Ministry for confidentiality review and approval two months before the exhibition.
(two) after examination and approval of the exhibition project, the science and technology department issued the "science and technology security review certificate", and reported to the national science and technology security office for the record. The organizer shall go through the foreign-related formalities in the relevant units with the certificate.
(3) During the validity period of the Science and Technology Confidentiality Examination Certificate, the certificate can be used many times without changing the exhibition content. Article 6 When organizing foreign-related scientific and technological exhibitions, expositions and scientific and technological performances, all relevant units of the Ministry must strictly perform the scientific and technological confidentiality review procedures. Anyone who conceals the real situation, practices fraud, defrauds the science and technology confidentiality review certificate, and exhibits it to the outside world without the approval of the science and technology confidentiality review, should seriously investigate the responsibility of the relevant personnel and leaders according to the seriousness of the circumstances, the degree of revealing the science and technology secrets and the size of the losses caused to the country. If the circumstances are serious, the judicial organs will deal with them according to law. Article 7 A unified Application Form for Science and Technology Confidentiality Examination of Foreign-related Science and Technology Projects and a Science and Technology Confidentiality Examination Certificate (style omitted) are attached. Article 8 These Measures shall come into force as of the date of promulgation and shall be interpreted by the Science and Technology Department of the Ministry of Posts and Telecommunications.
