Chapter 1 General Provisions Article 1 In order to strengthen the protection of cultural heritage, inherit and promote the excellent traditional culture of the nation, in accordance with the "Intangible Cultural Heritage Law of the People's Republic of China and the People's Republic of China" and the "Intangible Cultural Heritage Law of the People's Republic of China" The National Cultural Relics Protection Law, the Yunnan Province Intangible Cultural Heritage Protection Regulations and other laws and regulations are formulated based on the actual conditions of Yuanjiang Hani Yi and Dai Autonomous County (hereinafter referred to as the autonomous county). Article 2 These regulations shall apply to the protection, rescue, dissemination, inheritance and development and utilization of cultural heritage within the administrative areas of autonomous counties. Article 3 The cultural heritage referred to in these Regulations includes:
(1) The languages ??and characters of Hani, Yi, Dai and other ethnic groups;
(2) Hani Brown Fan Dance , nine sacrifices, "Ali" of the Yi people, music and dance, masked love songs of the Dai people, lion dance and other representative ethnic folk dances, music, musical instruments, poetry, drama;
(3) Concentrated reflection Traditional etiquette, sports, entertainment, clothing, tools, utensils and traditional handicrafts of national production and life customs;
(4) National folk traditional medicine;
(5) Hani people Traditional ethnic festivals such as the October Year, the Yi Torch Festival, and the Dai Flower Street Festival;
(6) Traditional villages and ethnic groups such as Take Village, Zhega Village, Poyuan Village, Erzhang Village, and Talang Village Traditional cultural and ecological reserves, ethnic minority characteristic villages, as well as representative buildings, facilities, signs and specific places;
(7) Manuscripts, scriptures, classics, pictures, Genealogy tablets, tablets, couplets, calligraphy and painting, stone carvings, wood carvings, sculptures, earthen pottery, etc.;
(8) Historical sites such as Take rock paintings, Yuanjiang White Pagoda, and Wayuan Bronze Age ruins;
(9) The former site of the Xiaobaimu military and political cadre training class, the site of the Zuoke Uprising, the site of the Chinese People's Liberation Army's pursuit and annihilation battle in southern Yunnan, the site of the Zhujie ambush battle, the site of the Walong attack battle, the former site of the Yuanjiang County Committee of the Communist Party of China and Li Hecai Former residence;
(10) Other cultural heritage that needs to be protected. Article 4: The protection of cultural heritage adheres to the principles of government leadership, social participation, protection first, rational utilization, inheritance and development. Article 5 The people's government of an autonomous county shall incorporate the protection of cultural heritage into the national economic and social development plan, and the required funds shall be included in the fiscal budget at the same level. Article 6: The autonomous county people’s government shall establish cultural heritage protection funds. Main sources of funds:
(1) Funds arranged by county-level fiscal budget;
(2) Support funds from superiors;
(3) Social donations;< /p>
(4) Other funds. Article 7 An autonomous county shall establish a cultural heritage evaluation committee to be responsible for the evaluation of cultural heritage, and its members shall be hired by the autonomous county cultural competent department. Article 8 The cultural authorities of autonomous counties are responsible for the protection of cultural heritage. Its main responsibilities are:
(1) Promote and implement the regulations and relevant laws and regulations;
(2) Organize and carry out the investigation, census, collation, translation and publication of cultural heritage resources , research and collection work;
(3) Formulate specific measures for cultural heritage protection and carry out rescue protection of endangered cultural heritage;
(4) Manage cultural heritage protection funds , and supervise their use;
(5) Guide and supervise the development and utilization of cultural heritage resources;
(6) Organize the application for representative inheritors and inheritance of intangible cultural heritage projects Units and cultural heritage inheritance towns (streets);
(7) Penalties for violations of these regulations;
(8) Other responsibilities for cultural heritage protection. Other relevant functional departments in autonomous counties should do a good job in cultural heritage protection in accordance with their respective responsibilities. Article 9 The township (town) people's government (subdistrict office) shall do a good job in protecting cultural heritage within its jurisdiction. Village (resident) committees should assist in work related to the protection of cultural heritage. Article 10 The people's government of the autonomous county shall incorporate cultural heritage protection into the rule of law publicity and education plan, and June of each year shall be Cultural Heritage Protection Publicity Month.
The public media in autonomous counties should adopt various forms to publicize knowledge related to cultural heritage protection. Chapter 2 Protection and Management Article 11 The competent cultural department of the autonomous county shall organize the preparation of a cultural heritage protection list and a cultural heritage protection plan, which shall be reviewed by the cultural heritage review committee and reported to the autonomous county people's government for approval before being announced and implemented. Article 12 The cultural heritage protection plan shall carry out rescue protection of endangered cultural heritage, highlight the protection of historical sites and relics, focus on the cultivation of folk cultural industries, strengthen the education of patriotism and revolutionary traditions, and promote the development of revolutionary historical and cultural tourism. Article 13: Traditional dwellings and historical sites in traditional villages shall remain in their original state. For traditional dwellings that really need to be maintained and repaired, the people's government of the autonomous county should take measures to support their repair and transformation in accordance with the principle of "repairing the old as before" while ensuring safety, so as to maintain the original pattern and style of the traditional village. Article 14 Autonomous counties should strengthen the construction of public cultural infrastructure such as ethnic museums, intangible cultural heritage exhibition venues, and practice centers, increase investment in folk art groups, and focus on cultivating various talents in ethnic culture and art to promote ethnic culture and art. cultural development. Article 15: Encourage citizens, legal persons and other organizations to donate their collections of cultural heritage materials and objects to state agencies, collections and research institutions in autonomous counties.
The recipient unit shall provide rewards based on the value of the donation. When collecting cultural heritage materials and objects owned by citizens, legal persons and other organizations, the prices shall be reasonably determined in accordance with the principle of fairness and voluntariness.
