The main duties of the prison procuratorial department include: ① supervising the legality of criminal activities carried out by prisons (including juvenile detention centers), detention centers, detention centers and other executive organs; (two) to supervise the legality of the activities of the reeducation-through-labor organs; (three) to supervise the commutation and parole ruled by the people's court, and the examination and approval (decision) of the prison management department and the people's court on whether the temporary execution outside prison is improper; (four) to check whether the criminal suspects and defendants detained in the detention center have been detained for an extended period; ⑤ Investigating and handling cases of duty crimes such as corruption, bribery, dereliction of duty and infringement by law enforcement judicial personnel in the process of penalty execution and supervision reform; ⑥ Review criminal cases of arresting prisoners and criminal cases of reeducation through labor, review and prosecute, and supervise investigation activities.
In accordance with relevant regulations, provincial procuratorates or municipal procuratorates set up procuratorates in large prisons, reeducation-through-labor camps or prisons and reeducation-through-labor camps. Other prisons, reeducation-through-labor camps and detention centers shall be set up by the city, state procuratorate or grass-roots procuratorate where the supervision place is located, and the procurators stationed shall carry out procuratorial work and perform procuratorial supervision duties according to law. If there are fewer detainees in the supervision place, the local procuratorate shall send full-time prosecutors or carry out patrol inspections.
