If I write a novel with the same name as others, and some of them are homologous, is it plagiarism? Can it be published?

It is plagiarism, but there are many such cases and should be treated differently.

For example; The Legend of the Swordsman of Shushan was written by the landlord in Zhu Huan during the Republic of China. Now fan fiction in Shushan has many starting points, and even the plots are similar. However, the landlord who returned the pearl has become a cup of loess, so even if the plagiarist bears legal responsibility, no one will sue.

Second; Jin Yong, Gu Long and other colleagues, these are all masters, know, but have a wide heart. For example, Jin Yongxin, a bird man, pretended to be Jin Yong's name, wrote novels and called him Jin Yong's new book, but Jin Yong didn't sue him.

Third; Foreign comics, novels and such novels are generally no problem.
