Article 2 These Regulations shall apply to the protection and development of Mongolian medicines within the administrative area of this Municipality. If the superior law has already made provisions, its provisions shall prevail.
Article 3 The objects of protection of intangible cultural heritage of Mongolian medicine include:
(a) single and compound Mongolian medicine;
(2) The unique medicinal materials, processing technology and preparation technology of Mongolian medicine;
(3) Germplasm resources and gene resources of wild Mongolian medicinal materials, and cultivation and breeding techniques of genuine medicinal materials;
(4) Ancient books and documents related to Mongolian medicine;
(5) Articles and places related to Mongolian medicine;
(six) other protected objects related to Mongolian medicine.
Article 4 The protection and development of Mongolian medicine should follow the development law of Mongolian medicine, adhere to standardization and marketization, persist in inheriting the essence, maintain integrity and keep innovating, give play to the unique advantages of Mongolian medicine, and serve the health of the whole people.
Article 5 The people's governments of cities, banners and counties shall incorporate Mongolian medicine into the national economic and social development plan, formulate and implement supporting policies, reform the system and mechanism of Mongolian medicine, set up special funds for Mongolian medicine and incorporate them into the fiscal budget, establish a system of joint departmental meetings, build the whole industrial chain of Mongolian medicine in the city, and promote the standardization, systematization and informatization of Mongolian medicine.
Article 6 The competent department of Mongolian medicine industry development of the people's governments of cities and counties shall be responsible for coordinating the development of Mongolian medicine industry and perform the following duties:
(1) Organizing the formulation and implementation of the development plan of Mongolian pharmaceutical industry;
(two) to guide the coordinated development of Mongolian medicine production, teaching, scientific research and application;
(three) to declare, establish and organize the implementation of major projects for the development of Mongolian medicine industry;
(four) to collect, sort out, feedback and publish the information of Mongolian medicine industry;
(five) to undertake the daily work of the joint meeting of departments;
(six) other duties related to the development of Mongolian medicine industry.
Article 7 The market supervision departments of the people's governments of cities, counties and counties shall be responsible for supervising and inspecting the operation and use of Mongolian medicines, establishing a quality traceability system for Mongolian medicines and decoction pieces, promoting clinical evidence-based research on Mongolian medicines and preparations, and organizing intellectual property protection.
Article 8 The competent health departments of the people's governments at the city, banner and county levels are responsible for screening diseases suitable for Mongolian medicine treatment, summarizing and forming treatment plans, and organizing clinical research on Mongolian medicine prevention and treatment of common diseases, frequently-occurring diseases, difficult and serious diseases and emerging infectious diseases.
Article 9 The competent departments of agriculture and animal husbandry of the people's governments of cities, counties and banners are responsible for planning and constructing authentic and large-scale production bases of medicinal materials, establishing a traceability system of medicinal materials quality, supervising and managing the use of agricultural inputs, and promoting the certification of geographical indications of medicinal materials.
Tenth city and county people's government departments in charge of science and technology are responsible for guiding the scientific and technological innovation of Mongolian medicine, improving the construction of innovation and service platform, organizing the implementation of scientific and technological projects of Mongolian medicine, and promoting the transformation of scientific and technological achievements.
Article 11 The competent department of cultural tourism of the people's governments at the city, banner and county level is responsible for organizing the declaration, evaluation and recommendation of the representative items of intangible cultural heritage of Mongolian medicine, identifying the representative inheritors, carrying out digital records of the representative items of intangible cultural heritage of Mongolian medicine, and promoting the combination of Mongolian medicine industry and tourism rehabilitation.
Article 12 The relevant departments of the municipal and county people's governments, such as development and reform, finance, industry and informatization, medical security, education, ethnic affairs, human resources and social security, forestry and grassland, commerce, etc., shall, according to their respective functions and duties, work together to do a good job in the protection and development of Mongolian medicine.
Article 13 Mongolian medicine production enterprises and medical institutions are encouraged to develop new Mongolian medicine and clinical preparations, improve the dosage forms of Mongolian medicine and preparations, clarify the ingredients, pharmacological effects, toxicity and adverse reactions of Mongolian medicine and preparations, express the name and description of Mongolian medicine in the national common language, apply for the inclusion of Mongolian medicine in the national basic medicine catalogue and the national medical insurance catalogue, and declare the representative items and inheritors of Mongolian medicine intangible cultural heritage.
Fourteenth encourage Mongolian medicine research institutions, academic groups, protection units and other organizations and individuals to engage in the excavation, rescue and protection of classical prescriptions, prescriptions, secret recipes and commonly used prescriptions of Mongolian medicine.
Fifteenth to encourage organizations and individuals who own ancient Mongolian medicine literature, physical objects, intellectual property rights or proprietary technology to participate in the distribution of benefits through legal transfer, cooperative development and other ways to develop the Mongolian medicine industry.
Article 16 State organs and their staff members who neglect their duties, abuse their powers or engage in malpractices for selfish ends in the protection and development of Mongolian medicine shall be punished according to law by the directly responsible person in charge and other directly responsible personnel; If a crime is constituted, criminal responsibility shall be investigated according to law.
Article 17 These Regulations shall come into force on March 1 day, 2022.
