The whole society should care about and respect the object of pension and preferential treatment, and carry out various forms of activities to support the army and give preferential treatment to its dependents.
Encourage social organizations and individuals to contribute to the cause of pensions and preferential treatment for servicemen. Article 4 The funds for pensions and preferential treatment for servicemen shall be borne by the people's governments at or above the county level in addition to the central financial burden. The funds for pensions and preferential treatment for servicemen shall be used exclusively, and shall be subject to the supervision of the financial and auditing departments. Article 5 The civil affairs departments of the people's governments at or above the county level shall be in charge of pensions and preferential treatment for servicemen within their respective administrative areas.
State organs, social organizations, enterprises and institutions shall perform their respective duties and obligations of pension and preferential treatment for servicemen according to law. Article 6 Survivors of martyrs, soldiers who died in the line of duty, and deceased soldiers shall be issued with the Certificate of Martyrs in People's Republic of China (PRC), the Certificate of Sacrifice in the Line of Duty in People's Republic of China (PRC), and the Certificate of Death in People's Republic of China (PRC) (hereinafter referred to as the "Certificate") by the civil affairs department of the people's government at the county level.
The holder of the certificate shall be determined through consultation by his parents (dependents), spouse, children and brothers and sisters, and the consultation result shall be informed to the issuing authority in writing; If negotiation fails, it shall be determined in the following order:
(1) Parents (dependents).
(2) spouse.
(3) Children (if there are multiple children, the oldest child shall prevail).
(4) Brothers and sisters (if there are multiple brothers and sisters, send them to the elders).
If there are no survivors listed in the preceding paragraph, the certificate will not be issued. Article 7 The one-time pension shall be paid by the civil affairs department of the people's government at the county level where the holder lives in accordance with the standards prescribed by the state in the following ways:
(a) parents (dependents), spouses and children agree to allocate the amount, according to the amount determined through consultation; If negotiation fails, equal payment shall be made according to the number of people.
(2) If there are no parents (dependents), spouses or children, they will be given to brothers and sisters under 18 years of age and brothers and sisters who have reached 18 years of age but have no source of living expenses and were supported by the soldier before their death. If there are more than two brothers and sisters, the amount shall be paid according to the amount determined through consultation; If negotiation fails, equal payment shall be made according to the number of people.
If there are no survivors as stipulated in the preceding paragraph, no one-time pension will be paid. Article 8 Survivors of martyrs, soldiers who died in the line of duty, and deceased soldiers who meet the requirements stipulated in the Regulations on Pension and Preferential Treatment for Soldiers shall enjoy regular pensions according to the standards stipulated by the state. The regular pension shall be paid by the civil affairs department of the people's government at the county level where the survivors are registered.
Survivors who apply for regular pensions shall register with the civil affairs department of the people's government at the county level where their household registration is located. The civil affairs department shall, within 30 days from the date of accepting the application for registration, verify it, and issue a certificate of regular pension to those who meet the statutory conditions; Do not meet the statutory conditions, it shall inform the reasons in writing. "Regular pension certificate" is uniformly printed by the civil affairs department of the people's Government of the autonomous region. Article 9 The regular pension shall be calculated and paid from the month when a serviceman dies and is approved as a martyr, confirmed as having died in the line of duty or died.
If there are more than two survivors and their household registration is not in the same place, the civil affairs departments of the people's governments at the county level where their household registration is located shall issue regular pensions respectively. Article 11 Where disabled soldiers retired from active service needs to be equipped with prosthetic limbs, tricycles and other assistive devices, it shall submit a written application to the civil affairs department of the people's government at the county level where its domicile is located, and after the consent of the civil affairs department of the people's government of the autonomous region, it shall be equipped at the designated institution. The required installation and configuration costs shall be solved by the civil affairs department of the people's Government of the autonomous region.
Disabled soldiers's round-trip travel expenses and the freight of wheelchairs, tricycles and other auxiliary devices for installing artificial limbs shall be settled by the civil affairs department of the people's government at the county level where the household registration is located. Twelfth conscripts after serving in active service, their families by the people's government at the county level where the household registration at the time of enlistment to give family preferential payments every year. The resettlement fee for conscripts shall not be less than 1.5 times of the local per capita net income of farmers and herdsmen in the previous year, and the required funds shall be included in the fiscal budget of the people's government at the county level.
The family members of conscripts who have won the honorary title or rendered meritorious service shall be given a one-time preferential payment by the civil affairs department of the people's government at the county level according to the following proportion:
(a) won the honorary title, won the first class merit, additional 50%.
(two) two, additional 30%.
(3) Category III, with additional 15%.
Those who have won honorary titles or rendered meritorious service for many times during the year shall be given a one-time preferential bonus in accordance with the highest level stipulated in the preceding paragraph.
