The way of public bidding embodies the essential requirements of market mechanisms such as information disclosure, procedural norms, fair competition, objective evaluation, fair selection and survival of the fittest.
Because there are many bidders in public bidding, the competition is full, and it is not easy to collude in bidding, which is conducive to the tenderer to choose the right winning bidder from a wide range of competitors and obtain the best competitive benefits.
If a project that must be subject to tender according to law must be publicly tendered, a pre-qualification announcement or tender announcement shall be issued in the media designated by the National Development and Reform Commission and other relevant departments according to law. Potential bidders who meet the qualifications specified in the project subject to tender may apply to participate in the bidding without being restricted by regions or industries.
Public bidding can be divided into domestic public bidding and international public bidding according to the open geographical scope.
Legal basis:
Article 54 of the Regulations for the Implementation of the Bidding Law of People's Republic of China (PRC), the tenderee shall publicize the successful candidate within 3 days from the date of receiving the bid evaluation report, and the publicity period shall not be less than 3 days. Bidders or other interested parties who have objections to the bid evaluation results of projects that must be subject to tender according to law shall raise them within the publicity period of the successful candidate. The tenderer shall make a reply within 3 days from the date of receiving the objection; Before giving a reply, the tendering and bidding activities shall be suspended.
