1. The divorce agreement of the Civil Affairs Bureau is legally binding after it is signed by both parties and recognized by law. After this agreement comes into effect, it shall not be changed at will and must be implemented. Divorce agreement is a comprehensive written agreement integrating personal relationship, property relationship and support relationship. If there is fraud or coercion in the divorce agreement, the divorce agreement is invalid.
2. Legal basis: Article 1076 of the Civil Code of People's Republic of China (PRC).
If the husband and wife voluntarily divorce, they shall sign a written divorce agreement and apply for divorce registration in person at the marriage registration office. The divorce agreement shall specify the expression of willingness of both parties to divorce and the consensus on matters such as child support, property and debt disposal.
2. Does the Civil Affairs Bureau divorce agreement need to be notarized?
The divorce agreement needs to be filed with the Civil Affairs Bureau and has legal effect. Notarization has little meaning. The divorce agreement may or may not be notarized. The divorce agreement shall take effect after both husband and wife go through the divorce registration formalities at the civil affairs department. Even if the divorce agreement has been notarized, the divorce agreement will not take effect until both parties have gone through the divorce formalities. Notarization of divorce agreement is of little significance and unnecessary. The parties may also choose to notarize the divorce agreement for insurance reasons.
