If the people's court accepts a case of public prosecution and applies ordinary procedures, it shall pronounce a judgment within two months after accepting it, but not more than three months at the latest. If the judgment is pronounced in court, the judgment shall be served on the parties within five days; If the sentence is pronounced regularly, it shall be served on the parties immediately after the sentence is pronounced.
The people's court may serve litigation documents on the parties who have no domicile in the territory of People's Republic of China (PRC) in the following ways:
1, served in the manner specified in the international treaty concluded between the country where the addressee is located and People's Republic of China (PRC) or attended by both parties;
2. Transmission through diplomatic channels;
3. For the addressee with China nationality, the embassy or consulate of China in the country where the addressee is located may be entrusted to serve on his behalf;
4. The agent ad litem entrusted by the addressee shall have the right to accept the service on his behalf;
5. Serving on the representative office established by the addressee in People's Republic of China (PRC) or the branch or business agent with the right to accept the service;
6. If the law of the country where the addressee is located allows it to be served by mail, it may be served by mail. The delivery receipt has not been returned for three months from the date of mailing, but if it is deemed to have been delivered according to various circumstances, it shall be deemed that the delivery period has expired;
7. Confirm the recipient's receipt by fax or e-mail;
8. If it cannot be served in the above way, the announcement shall be deemed to have been served three months after the date of announcement.
To sum up, a party who has no domicile in People's Republic of China (PRC) refuses to accept the judgment or ruling of the people's court of first instance and has the right to appeal within 30 days from the date when the judgment or ruling is served. After receiving a copy of the appeal, the appellee shall submit a defense within 30 days. If a party fails to file an appeal or reply within the statutory time limit and applies for an extension, whether to grant it or not shall be decided by the people's court.
