Regulations for the Implementation of the Copyright Law of the People's Republic of China

chapter I general provisions article 1 these regulations are formulated in accordance with the provisions of article 54 of the copyright law of the people's Republic of China (hereinafter referred to as the copyright law). Article 2 The term "works" as mentioned in the Copyright Law refers to intellectual creations that are original and can be reproduced in some tangible form in the fields of literature, art and science. Article 3 Creation as mentioned in the Copyright Law refers to intellectual activities that directly produce literary, artistic and scientific works.

organizing work, providing advice, material conditions or other auxiliary activities for others' creation are not regarded as creation. Article 4 The meanings of the following works in the Copyright Law and these Implementing Regulations are:

(1) Literary works refer to works expressed in written form such as novels, poems, essays and papers;

(2) Oral works refer to works created in oral language such as impromptu speeches, lectures and court debates, which are not fixed by any material carrier;

(3) Musical works refer to symphonies, songs and other works with or without words that can be sung or played;

(4) Dramatic works refer to dramas, operas, local operas and other works for stage performances;

(5) Quyi works refer to works in which the main form of performance is rap, such as cross talk, fast writing, drum and storytelling;

(6) Dance works refer to works expressed through continuous movements, postures and expressions;

(7) Art works refer to plane or three-dimensional plastic art works with aesthetic significance, such as painting, calligraphy, sculpture and architecture, which are formed by lines, colors or other means;

(8) Photographic works refer to artistic works that record the images of objective objects on photosensitive materials by means of instruments;

(9) cinematographic, television and video works refer to works which are shot on a certain material and consist of a series of pictures with or without sound, and which are shown and played by appropriate devices;

(1) engineering design and product design drawings and their descriptions refer to drawings drawn for construction and production and written descriptions of drawings;

(11) Graphic works such as maps, schematic diagrams, etc. refer to maps, circuit diagrams, anatomical diagrams, etc. which reflect geographical phenomena and explain the principle or structure of things. Article 5 The following ways of using a work in the Copyright Law and these Implementing Regulations mean:

(1) Copying refers to the act of making one or more copies of a work by printing, copying, copying, rubbing, recording, video recording, copying, etc.

(2) Performance refers to the public reproduction of works with sounds, expressions and movements, directly or with the help of technical equipment, such as playing music, staging scripts and reciting poems;

(3) broadcasting refers to the dissemination of works through radio waves and cable television systems;

(4) Exhibition means the public display of the originals or duplicates of works of art and photography;

(5) Distribution refers to providing a certain number of copies of works to the public by selling or renting to meet the reasonable needs of the public;

(6) Publication refers to the editing and processing of a work, and its reproduction and distribution to the public;

(7) Making a film, television or video work means fixing the work on a certain carrier for the first time by making a film or by similar means. The mechanical recording of a performance or scene is not regarded as the production of a film, television or video work;

(8) adaptation refers to the creation of new works with originality by changing the expression or use of the works on the basis of the original works;

(9) Translation refers to the conversion of a work from one language to another;

(1) Annotation refers to the explanation of words, words and sentences in written works;

(11) editing refers to selecting several works or pieces of works according to specific requirements and compiling them into one work;

(12) collation refers to the orderly and systematic processing of existing written works or materials with scattered contents and unclear levels, such as collation and addendum of ancient books. Article 6 The meanings of the following terms in the Copyright Law and these Implementing Regulations are:

(1) Current affairs news refers to pure factual news reported through newspapers, periodicals, radio stations, television stations and other media;

(2) Sound recordings refer to the original recordings of any sound;

(3) Video products refer to any original recorded products with or without continuous related images other than movies, television and video products;

(4) Radio and television programs refer to programs transmitted by radio stations and television stations through signals containing sounds and images;

(5) producers of sound recordings refer to those who make sound recordings;

(6) video producer means the person who makes video products;

(7) Performer means an actor or other person who performs literary or artistic works. Chapter II Copyright Administration Article 7 The National Copyright Administration is the copyright administration department of the State Council, which is in charge of copyright administration throughout the country. Its main responsibilities are:

(1) to implement copyright laws and regulations and formulate measures related to copyright administration;

(2) to investigate and deal with copyright infringement cases with great influence in the whole country;

(3) to approve the establishment of copyright collective management institutions, foreign-related agencies and contract dispute arbitration institutions, and to supervise and guide their work;

(4) to be responsible for the foreign-related management of copyright;

(5) to be responsible for the management of copyright enjoyed by the state;

(6) to guide the work of local copyright administrative departments;

(7) to undertake other copyright management tasks assigned by the State Council.
