Beijing Interim Measures for the Management of Chinese Calligraphy and Painting Operations

Article 1: In order to strengthen the management of Chinese calligraphy and painting business activities and maintain the normal order of the calligraphy and painting market, these Measures are formulated in accordance with relevant national regulations. Article 2 All Chinese paintings and Chinese calligraphy works (including original works, copies, and antique works, hereafter collectively referred to as calligraphy and paintings) operating within the administrative area of ??this city shall be managed in accordance with these regulations.

The operation of calligraphy and paintings that are cultural relics shall be managed in accordance with the relevant regulations of the state and this city on the management of cultural relics, and this method does not apply. Article 3 The Municipal Culture Bureau is responsible for the management of calligraphy and painting business activities in this city. District and county cultural administrative agencies, under the guidance of the Municipal Culture Bureau, are responsible for the daily supervision and management of calligraphy and painting business activities in their respective jurisdictions. Article 4 Units operating calligraphy and painting must meet the following conditions:

1. To engage in the business of purchasing and selling calligraphy and painting, they must have corresponding operating conditions and qualified professional appraisers of calligraphy and painting.

2. To engage in the consignment business of calligraphy and painting, one must have a fixed business location and a stable source of calligraphy and painting. Among them, consignment units with calligraphy and painting professionals can engage in specific scopes of acquisition and sales, self-sales, consignment and other businesses.

Those who have permanent residence in this city, have the ability to create calligraphy and painting, and meet the conditions for self-employment can apply to open an individual painting shop or run a concurrent calligraphy and painting business. Article 5 Business operations in calligraphy and painting must be submitted for review and approval in accordance with the following provisions:

1. Upon review and approval by the Municipal Culture Bureau, the business scope shall be determined and a calligraphy and painting business license shall be issued;

2. For a calligraphy and painting business license, apply for a business license from the district or county industrial and commercial administration bureau.

Without approval, calligraphy and painting acquisition, sales and consignment business are not allowed. Article 6 If a calligraphy and painting business unit establishes a branch or joint operation, rents a counter, or changes its business scope or business location, it must go through the corresponding approval or change registration with the original approved culture and industrial and commercial administrative authorities. Article 7 When holding a charity sale or auction of calligraphy and painting, the organizer of the charity sale or auction must submit the catalog and sales quantity of calligraphy and painting to the Municipal Culture Bureau for approval in advance, and apply for a temporary sales license. Article 8 The calligraphy and painting business license is valid for 2 years from the date of issuance. One month before the expiration of the validity period, the business unit must present the original certificate and re-apply for approval and registration in accordance with the provisions of Article 5 of these Measures. If the declaration is not made within the time limit, the Municipal Culture Bureau will request the industrial and commercial administration to revoke the business license or cancel the calligraphy and painting business project. Article 9 When operating calligraphy and painting, the following regulations must be observed:

1. Implement high quality and low prices, and shall not pass off inferior works as good ones, and shall not sell forged or counterfeit works.

2. Operate within the approved scope. The consignment unit shall not engage in acquisition or non-consignment exhibition and sales business. The calligraphy and painting sold on consignment shall be provided by calligraphy and painting business units with acquisition business. Individual painting shops (including part-time businesses) are only allowed to sell the works of their creative staff and engage in consignment business, and are not allowed to engage in acquisition business.

3. Do not solicit business by illegal means such as paying personal kickbacks.

4. Accept inspection, supervision and guidance from inspectors of culture, cultural relics, price, and industrial and commercial administrative departments. Article 10 The Municipal Culture Bureau, district and county cultural administrative agencies and their inspectors shall, in accordance with these Measures, conscientiously perform their duties and conduct regular inspections and supervision of the calligraphy and painting market. Inspectors should produce their credentials when performing their duties. Article 11 Anyone who violates these Measures shall, depending on the seriousness of the case, be given a warning, suspend business for rectification, confiscate illegal gains and illegally purchased and sold calligraphy and painting, and impose a fine of 10% to 50% of the total price of illegally operated calligraphy and painting; If the circumstances are serious, the calligraphy and painting business license shall be revoked, and the business license shall be revoked or the calligraphy and painting business project shall be canceled by the industrial and commercial administration authority.

Punishment decisions made by the district or county cultural administrative organs to confiscate illegal gains or impose a fine of more than 3,000 yuan and suspend business for rectification shall be approved by the district or county people's government; the revocation of the calligraphy and painting business license must be reported to the Municipal Culture Bureau, approved by the Municipal Culture Bureau and notified for implementation. Article 12: The Municipal Culture Bureau is responsible for explaining any problems arising from the specific implementation of these Measures.

The implementation details of these measures shall be formulated by the Municipal Culture Bureau. Article 13: These Measures shall come into effect on December 1, 1988.
