How can we stay away from domestic violence,

Domestic violence refers to the physical and mental aggression between family members by beating, binding, mutilation, restriction of personal freedom, frequent abuse and intimidation. That is to say, even if one party just slaps the other party, it is also a domestic violence. If the victim is seriously injured or killed because of the perpetrator's continuous and frequent domestic violence, he shall be convicted and punished for intentional injury or intentional homicide. If family members often encounter domestic violence, victims can take the following measures to protect their rights:

1, the victim can call the police in time. According to Article 45 of the Law of People's Republic of China (PRC) on Public Security Administration Punishment (the Law), if an abused family member asks for treatment, the public security organ shall impose administrative detention or warning on the perpetrator for less than five days according to law. (Public security organs impose "administrative detention" or "warning" punishment on the perpetrator according to law, which belongs to the category of administrative punishment. The victim must keep the decision of administrative punishment or the notice of administrative detention of family members issued by the public security organ for use with valid documentary evidence when going to court in the future. )

2. The victim may apply to the people's court at the place of residence or where domestic violence occurs for a personal safety protection order. According to the provisions of Chapter IV of the Domestic Violence Law of People's Republic of China (PRC) (the Law), the people's court may take the following measures against the injurer:

(1), prohibiting the perpetrators from continuing to commit domestic violence;

(2) The abuser is prohibited from harassing, stalking or contacting the applicant and his related close relatives;

(3) Ordering the actor to move out of the applicant's residence;

(4) Other measures to protect the personal safety of the applicant.

3. Bring a divorce lawsuit to the people's court. According to the provisions of Item 2, Paragraph 3 of Article 1079 and Item 3 of Article 109 1 of the Civil Law of People's Republic of China (PRC) (hereinafter referred to as the Law), the people's court shall grant divorce to those who commit domestic violence or abuse or abandon family members. At the same time, the innocent party has the right to claim damages.
