Regulations of Quanzhou Municipality on the Protection of Water Environment in Jinjiang Luoyang River Basin

Chapter I General Provisions Article 1 In order to protect and improve the water environment in Jinjiang and Luoyang River basins, prevent and control water pollution in Jinjiang and Luoyang River basins, ensure the safety of drinking water and public health, and promote the construction of ecological civilization and sustainable economic and social development, in accordance with the People's Republic of China (PRC) Water Law, the People's Republic of China (PRC) Environmental Protection Law, the People's Republic of China (PRC) Water Pollution Prevention Law and other relevant laws and regulations, and in combination with the actual situation of this Municipality, Article 2 These Regulations are applicable to the planning, protection and protection of Jinjiang and Luoyang River basins within the administrative area of this Municipality. Where there are other provisions in laws and regulations on the protection of river basin water environment, such provisions shall prevail.

The Jinjiang River Basin as mentioned in these Regulations refers to the catchment area of all major tributaries from the source of Jinjiang to the estuary of Chongxun Pugun City, including the Longmentan Reservoir Basin of the external diversion project; Luoyang River Basin refers to the catchment area of all major tributaries from the source of Luoyang River to the exit of Luoyang Bridge Gate.

The term "upstream of Jinjiang River Basin" as mentioned in these Regulations refers to the area above Jinjihe Gate in Jinjiang City. Article 3 The water environment protection in Jinjiang and Luoyang River basins shall adhere to the principles of government leading, social participation, prevention first and comprehensive management, and correctly handle the relationship between water environment protection and economic development and people's livelihood security to ensure that the water environment quality can only be better, but not worse. Article 4 The people's governments of cities, counties (cities, districts) and townships (street offices) shall be responsible for the water environment protection of Jinjiang and Luoyang River basins within their respective administrative areas. The implementation of the target responsibility system and assessment system for river basin water environmental protection, and the completion of the target of river basin water environmental protection as the content of the assessment of the people's government at a higher level to the people's government at a lower level and its responsible person.

The people's governments of cities and counties (cities, districts) shall incorporate the water environmental protection work in Jinjiang and Luoyang River basins into the national economic and social development plan, formulate the water environmental protection targets and annual implementation plans, and include the protection funds in the fiscal budget at the same level.

Township People's governments (street offices) are responsible for organizing the implementation of the environmental supervision responsibilities determined by the grid environmental supervision system in accordance with the territorial management responsibilities, stopping, handling and reporting to the people's governments at higher levels and departments responsible for the supervision and management of river basin water environmental protection according to law.

Encourage and support the village (neighborhood) committees to organize the formulation of village rules and regulations according to law, and guide the village (neighborhood) people on both sides of the river basin to consciously protect the water environment of the river basin. Article 5 The competent department of ecological environment of the Municipal People's Government shall implement unified supervision and management of water environmental protection in Jinjiang and Luoyang River basins.

The municipal and county people's governments in charge of development and reform, industry and information technology, public security, natural resources, urban and rural planning, housing and urban and rural construction, transportation, agriculture and rural areas, forestry, water conservancy, commerce, health, emergency management, marine and fishery, urban management and other departments shall, within their respective functions and duties, supervise and manage the water environmental protection of river basins. Article 6 The river (lake) length system shall be implemented for water environment protection in Jinjiang and Luoyang River basins, and the responsibility system for river (lake) length at the city, county and township levels shall be improved, and the water resources protection, shoreline management, water pollution prevention, water environment management and water ecological restoration in Jinjiang and Luoyang River basins within their respective administrative areas shall be organized and led by stages.

Improve the river (lake) patrol system, regularly carry out river (lake) patrol activities, and coordinate and solve major problems involving rivers (lakes). Chapter II River Basin Planning and Water Quality Requirements Article 7 The Municipal People's Government shall, according to the characteristics of river basins, organize the preparation of industrial development plans for Jinjiang and Luoyang River basins.

The people's governments of cities and counties (cities, districts) should adjust the economic structure, eliminate backward production capacity, encourage the use of clean energy and develop a green economy according to industrial policies such as river basin industrial development planning, national industrial structure adjustment guidance catalogue and negative list of industrial access in key ecological function areas. Article 8 The Municipal People's Government shall organize the preparation of water pollution prevention and control plans for Jinjiang and Luoyang River basins, and submit them for approval according to law.

The relevant county (city, district) people's government shall, according to the requirements of the water environment quality improvement target determined by the water pollution prevention and control plan of Jinjiang and Luoyang River basins, formulate a deadline for reaching the standard and take measures to reach the standard on schedule. The deadline for reaching the standard plan shall be reported to the Municipal People's government for the record and announced to the public. Ninth Jinjiang, Luoyang River Basin water quality should not be lower than the national "surface water environmental quality standards" class III standards. Among them, the main stream, tributaries and reaches above Class II standard should keep the water quality unchanged; The main stream, tributaries and river sections below Class III standards should gradually improve and improve the water quality. Tenth city, county (city, district) people's government should build Jinjiang, Luoyang River Basin water quality monitoring and early warning system, improve the real-time monitoring ability.

The competent department of ecological environment of the Municipal People's Government shall, jointly with the county (city, district) people's government, set up an automatic water quality monitoring station at the junction of the river basin and the county; City and county (city, district) people's governments set up automatic water quality monitoring stations in drinking water source protection areas and major lakes and reservoirs at or above the county level.

The competent department of ecological environment of the Municipal People's Government shall regularly announce the results of water quality monitoring in Jinjiang and Luoyang River basins to the public through the official website. Ecological environment, water conservancy, sanitation, urban management and other departments. A water quality monitoring information sharing mechanism should be established. Article 11 The people's governments of cities and counties (cities, districts) shall organize the relevant competent departments to take measures such as pollution control, dredging, wetland restoration and ecological protection belt construction. Co-ordinate the management of landscape, forest, field, lake and grass, protect and restore the water ecosystem, and build a livable environment with smooth rivers, clean banks and clean shores.

The people's governments of cities and counties (cities, districts) shall take measures such as afforestation to improve the vegetation coverage rate of river basins, enhance the water conservation capacity and prevent soil erosion.

It is forbidden for any unit or individual to introduce or release exotic aquatic species without authorization, change the ecological function and destroy the ecological environment.
