Chapter I General Principles
Article 1 In order to further strengthen the management of cultural relics protection projects, these Measures are formulated in accordance with the relevant provisions of the Cultural Relics Protection Law of People's Republic of China (PRC) and the Construction Law of People's Republic of China (PRC).
Article 2 The term "cultural relics protection project" as mentioned in these Measures refers to the protection project of immovable cultural relics, such as ancient cultural sites, ancient tombs, ancient buildings, cave temples and stone carvings, important historical sites in modern times, representative buildings and murals, which are approved as cultural relics protection units.
Article 3 Cultural relics protection projects must follow the principle of not changing the original state of cultural relics, and comprehensively preserve and continue the true historical information and value of cultural relics; According to internationally and domestically recognized norms, cultural relics and their related historical, cultural and natural environments should be protected.
Article 4 Cultural relics protection units shall formulate special overall protection plans, and cultural relics protection projects shall be implemented in accordance with the approved plans.
Fifth cultural relics protection projects are divided into maintenance projects, rescue and reinforcement projects, repair projects, protection facilities construction projects and relocation projects.
(1) Maintenance works refer to routine and seasonal maintenance of minor damage to cultural relics.
(2) Emergency rescue and reinforcement project refers to the project that takes reversible temporary emergency rescue and reinforcement measures for cultural relics when they suddenly appear in serious danger and cannot be completely repaired due to the limitations of time, technology and funds.
(3) Repair works refer to structural reinforcement and maintenance necessary for the protection of cultural relics, including local repair works combined with structural reinforcement.
(four) the construction project of protection facilities refers to the project of attaching safety protection facilities for the protection of cultural relics.
(5) Relocation project refers to the project that the whole or part of cultural relics are relocated for protection in different places because of the special needs of protection work and there is no other more effective means.
Article 6 National Cultural Heritage Administration is responsible for the management of national cultural relics protection projects, and organizes the formulation of relevant norms, standards and quotas for cultural relics protection projects.
Article 7 Legal entities that manage or use cultural relics, including state-approved organs, organizations, military units, schools, religious organizations and other enterprises and institutions, are the owners of cultural relics protection projects.
Eighth units that undertake the survey, design, construction and supervision of cultural relics protection projects must have the qualification of cultural relics protection projects recognized by National Cultural Heritage Administration. The qualification determination methods and grading standards shall be formulated separately by National Cultural Heritage Administration.
Ninth cultural relics protection project management mainly refers to the project, survey and design, construction, supervision and acceptance management.
Chapter II Project Establishment, Survey and Design
Tenth cultural relics protection projects shall be managed at different levels according to the level of cultural relics protection units, and the examination and approval procedures shall be performed in accordance with the following provisions:
1. Protection projects of national key cultural relics protection units shall be declared by the cultural relics administrative departments of provinces, autonomous regions and municipalities directly under the Central Government and examined and approved by National Cultural Heritage Administration.
The two provinces, autonomous regions and municipalities directly under the Central Government take the municipal and county-level administrative departments of cultural relics where the cultural relics are located as the reporting organs, and the administrative departments of cultural relics of provinces, autonomous regions and municipalities directly under the Central Government as the examination and approval organs.
The reporting authorities and examination and approval authorities of the municipal and county-level cultural relics protection units and immovable cultural relics protection projects that have not been approved as cultural relics protection units shall be determined by the provincial cultural relics administrative department.
Eleventh maintenance projects shall be included in the annual work plan and budget by the users of cultural relics, and shall be reported to the cultural relics administrative departments of provinces, autonomous regions and municipalities directly under the central government for the record.
The project establishment, survey and design scheme of emergency rescue and reinforcement project, repair project and protective facilities construction project shall be submitted for approval in accordance with the provisions of Article 10 of these Measures. If emergency rescue and reinforcement projects need to be implemented immediately due to emergencies, they can be supplemented at the same time.
After the relocation project is approved in accordance with the provisions of Article 20 of the People's Republic of China (PRC) Cultural Relics Protection Law, the survey and design scheme shall be submitted for approval in accordance with the provisions of Article 10 of these Measures.
Article 12 Where it is necessary to rebuild immobile cultural relics that have been completely destroyed in the original site due to special circumstances, after obtaining approval in accordance with the provisions of Article 22 of the Law of People's Republic of China (PRC) on the Protection of Cultural Relics, the survey and design scheme shall be submitted for approval in accordance with the provisions of Article 10 of these Measures.
Thirteenth project application materials include the following contents:
1. Name of project owner unit and superior competent department;
2 the name and location of the proposed project, the level and age of the cultural relics protection unit, the delineation, publication and implementation of the scope of protection and the construction control zone;
3. Technical documents, video materials, videos or photos on the necessity and implementation possibility of the protection project;
4. Capital estimation, source and schedule arrangement;
The name and credit information of the survey and design unit to be employed.
Fourteenth approved cultural relics protection projects, should declare the survey, scheme design and construction technical design documents. Major projects should be technically designed after the scheme is approved.
Fifteenth survey and design documents include:
1. Investigation reports, measured maps and photos reflecting the historical status, inherent characteristics and damage of cultural relics;
2. Protect the project plan, design drawings and related technical documents;
3. Engineering design budget;
When necessary, archaeological exploration and excavation data, material test reports, environmental pollution reports, engineering geological and hydrogeological data and exploration reports shall be provided.
Sixteenth construction technology design documents include:
1. Construction drawings;
2. Design specifications;
3. Construction drawing budget;
4. Test reports and test results of relevant materials.
Chapter III Construction, Supervision and Acceptance
Seventeenth renovation projects, protection facilities construction projects and relocation projects in cultural relics protection projects shall be subject to bidding and project supervision.
Eighteenth important cultural relics protection projects shall be submitted for approval in accordance with the procedures stipulated in Article 10 of these measures, and the construction unit shall be selected.
Nineteenth cultural relics protection projects must abide by the laws, regulations, rules and norms of the state on construction, and the purchased engineering materials should meet the quality requirements of cultural relics protection projects. The construction unit shall carry out the construction in strict accordance with the requirements of the design documents, and its working procedures are as follows:
A according to the design documents, prepare the construction plan;
(2) Before entering the site, the construction personnel should be trained in the relevant knowledge of cultural relics protection;
(3) According to the requirements of the cultural relics protection project, make construction records and construction statistical documents, and collect relevant cultural relics;
Four quality self-inspection, the hidden part of the project must be checked together with the owner, design unit and supervision unit and recorded;
5. Submit completion data;
6. Be responsible for the warranty according to the contract, and the warranty period shall be calculated from the date of completion acceptance, except for maintenance, emergency rescue and reinforcement projects, which shall be no less than five years.
Twentieth in the process of construction, such as the discovery of new cultural relics, relevant information or other major issues affecting the protection of cultural relics, should be recorded immediately, protect the site, and report to the original examination and approval authority for handling.
Twenty-first in the process of construction, if it is necessary to change or supplement the approved technical design, the project owner, design unit and construction unit should negotiate with the site and report to the original reporting authority for the record; If it is necessary to change the important contents of the approved project or scheme design, it must be reported and approved by the original reporting authority to the examination and approval authority.
Twenty-second cultural relics protection projects should be accepted by stages according to the working procedures. At the end of a major project, the project examination and approval authority shall organize or entrust the relevant units to carry out phased acceptance.
Twenty-third after the completion of the project, the owner unit shall, in conjunction with the design unit, construction unit and supervision unit, inspect and evaluate the project quality, and submit the project summary report, completion report, as-built drawings, financial statements and explanations, and submit them to the examination and approval authority after passing the preliminary inspection by the original reporting authority. The project examination and approval authority shall set up an acceptance team or entrust relevant units to organize the completion acceptance according to the actual situation of the project.
Twenty-fourth of the quality problems found in the acceptance of the project, the owner unit timely rectification.
Twenty-fifth owners of cultural relics protection projects, survey and design units, construction units, reporting organs and examination and approval authorities shall establish a file management system for administrative, technical and financial documents related to the project. All engineering data should be filed and classified into the archives of cultural relics protection units.
Important projects shall publish technical reports within three years after acceptance.
Chapter IV Reward and Punishment
Twenty-sixth cultural relics protection projects set up outstanding engineering award, the specific measures shall be formulated by the National Cultural Heritage Administration.
Twenty-seventh in violation of these measures, or damage to cultural relics, shall be punished in accordance with the "People's Republic of China (PRC) Cultural Relics Protection Law" and the relevant provisions of the State Council.
Chapter V Supplementary Provisions
Twenty-eighth non-state-owned immovable cultural relics protection and maintenance, with reference to these measures.
Twenty-ninth previously issued provisions are inconsistent with these measures, and the provisions of these measures shall prevail.
Thirtieth these Measures shall come into force as of May 6, 2003+0.
