1. According to the provisions of the second and fourth paragraphs of the Criminal Law, those who commit this crime shall be sentenced to fixed-term imprisonment of more than five years and fined; If the circumstances are minor, he shall be sentenced to fixed-term imprisonment of not more than five years and fined; If the circumstances are especially serious, he shall be sentenced to life imprisonment or death, and his property shall be confiscated. 2. According to the provisions of the fifth paragraph of the Criminal Law, if a unit commits this crime, it shall be fined, and the directly responsible person in charge and other directly responsible personnel shall be punished as natural persons for committing this crime in accordance with the provisions of the second and fourth paragraphs of this article. 3. According to paragraph 1 of Article 257 of the Criminal Law, whoever provides armed cover for smuggling shall be given a heavier punishment for this crime according to paragraph 1 and paragraph 4 of this article. 4. According to the second paragraph of Article 157 of the Criminal Law, those who resist anti-smuggling by violence or threats shall be punished with several crimes such as the crime of smuggling cultural relics and the crime of obstructing official duties as stipulated in Article 277 of this Law. Subjectively, this crime must be intentional, that is, cultural relics whose export is prohibited by the state are still deemed to be illegally carried, transported or mailed out of the country (territory). Negligence cannot constitute this crime. As for its motives, it can be varied, such as selling it abroad, giving it to people abroad and so on. But the motive does not affect the establishment of this crime.
