The administrative departments for industry and commerce of the people's governments at or above the county level shall, according to their functions and powers, supervise and manage the activities of copying and rubbing cultural relics according to law. Article 4 Units and individuals engaged in the reproduction and rubbings (including sales) of cultural relics (hereinafter referred to as cultural relics reproduction units) shall have cultural relics reproduction production sites, production equipment, inspection equipment and professional and technical personnel, and shall apply to the local people's government at the county level for the License for Reproduction and Rubbing of Cultural Relics and the License for the Sales of Reproduction and Rubbing of Cultural Relics before starting business.
Units and individuals engaged only in the sale of cultural relics replicas and rubbings shall handle the sales license and business license of cultural relics replicas and rubbings in accordance with the procedures specified in the preceding paragraph.
Without obtaining the License for Reproduction and Rubbing of Cultural Relics and the Sales License for Reproduction and Rubbing of Cultural Relics, the administrative department for industry and commerce shall not apply for a business license. Article 5 It is forbidden to rent, transfer, resell or forge the License for Reproduction and Rubbing of Cultural Relics and the License for Sales of Reproduction and Rubbing of Cultural Relics. Article 6 The cultural relics collected by the autonomous region shall be announced to the public in batches by the cultural administrative department of the autonomous region. Unpublished cultural relics shall not be copied. Article 7 The reproduction of cultural relics shall be subject to the examination and approval system.
The reproduction of first-class cultural relics shall be reported to National Cultural Heritage Administration for approval by the cultural administrative department of the autonomous region.
The reproduction of two or three cultural relics shall be approved by the cultural administrative department of the autonomous region. Article 8 When submitting a report for approval to copy cultural relics, a cultural relics copying unit shall submit a report to the cultural administrative department of the autonomous region.
The report shall include the following contents:
(a) the name, age, place and time of excavation of the copied cultural relics;
(2) Collection units;
(3) Photographs of cultural relics;
(4) The purpose, quantity and method of reproduction;
(five) the status of copying units, copying personnel and copying technology;
(6) Other relevant contents. Article 9 When copying cultural relics, a cultural relics copying unit shall sign a contract with a cultural relics collection unit. Article 10 Reproduction of cultural relics must be carried out in accordance with the approved types and quantities, as well as the size, shape, color, ornamentation, weight and texture of cultural relics.
Replicas of cultural relics shall be recorded in secret, reproduction instructions shall be made, and reproduction files shall be established.
Replicas of cultural relics for sale shall be marked with the word "replica". Article 11 No unit or individual may copy or imitate cultural relics by using replicas. Twelfth copies of cultural relics listed in the list of special precious cultural relics by the cultural administrative departments of National Cultural Heritage Administration and the autonomous region must hold the special invoices of the sales unit and the instructions of cultural relics copies, and be verified by the customs. Thirteenth cultural relics rubbings shall be submitted for approval. The specific examination and approval procedures and contents shall be implemented in accordance with the provisions of Article 7 and Article 8 of these Measures. Fourteenth the following cultural relics can be sold by rubbing:
(1) Calligraphy and stone carvings below the Yuan Dynasty;
(2) Stone carving images, stone carvings and classic buildings above the Yuan Dynasty, but they can only be copied in editions or printed in Cologne editions;
(3) Stone carving images, stone carvings and classic buildings below the Ming Dynasty;
(4) Precious calligraphy and stone carvings above the Song Dynasty that have been reproduced and disseminated for the second time;
(5) Rock paintings in this autonomous region. Fifteenth dissemination of the following stone carvings shall be approved by the administrative department of culture of the autonomous region in National Cultural Heritage Administration:
(a) the content involves China's territory, diplomacy and ethnic relations;
(two) the contents and pictures are astronomical, hydrological, geographical and other scientific materials;
(3) Unpublished epitaph.
The dissemination, exhibition and sale of the stone carvings specified in the preceding paragraph must be carried out in accordance with the approved types and quantities, and printing and sales are not allowed. Sixteenth units and individuals approved to engage in rubbings of cultural relics shall sign contracts with cultural relics protection units. Seventeenth in violation of the provisions of these measures, without the approval of the administrative department for culture, unauthorized copying and rubbing of cultural relics, confiscate the illegal property, and impose a fine of 2000 yuan to 20000 yuan. Article 18 Whoever, in violation of the provisions of these measures, sells copies and rubbings of cultural relics without authorization, the administrative department for industry and commerce of the people's government at or above the county level shall confiscate the illegal income and illegal articles, and impose a fine of less than three times the illegal income. Article 19 Anyone who, in violation of the provisions of Article 5 of these Measures, rents, transfers, resells or forges the License for Reproduction and Rubbing of Cultural Relics or the Sales License for Reproduction and Rubbing of Cultural Relics shall have his illegal income and illegal articles confiscated, and may also be fined more than 500 yuan 1000 yuan. Twentieth in violation of the provisions of article eleventh of these measures, the use of cultural relics copy or imitation, confiscate the illegal items, and impose a fine of more than 5000 yuan in 500 yuan. Article 21 Whoever, in violation of the provisions of these Measures, copies unpublished cultural relics or copies or rubbings cultural relics of unapproved types and quantities or copies or rubbings unapproved cultural relics shall be given a warning and all illegal items shall be confiscated.
