Keeping records is the basic duty of the staff. Recording is to record the whole process of trial activities in the trial court. The written record is a legal document that truthfully reflects the litigation activities in the process of the people's court handling criminal, civil, economic and administrative litigation cases in accordance with legal procedures. The work of the clerk in the whole lawsuit includes five aspects: First, the examination and registration of cases. After receiving the case, the clerk shall conduct a comprehensive review of whether the case materials are complete and complete, register the case after verification, and go through all the procedures for receiving the case. The second is the trial preparation and trial work. After the case is accepted and examined, once a court hearing is decided, the clerk should make all the preparations before the court hearing according to law, including filling in and serving all kinds of litigation documents, posting notices, arranging the court, announcing the matters needing attention in the court hearing, checking whether the persons who should appear in court are present, and reporting to the presiding judge; At the same time, in the trial, the clerk should conscientiously do all the work according to the deployment and arrangement of the judge, with the focus on completely and truly recording all the activities of the trial. After the recess, the clerk will also assist the judge to deal with the situations and matters that need to be dealt with during the court session.
Legal basis:
Article 2 of the Measures for the Administration of the Clerk of the People's Court stipulates that the duties of the clerk include the following five aspects:
(1) Handle the daily work in the pre-trial preparation process;
(two) to check the appearance of the participants in the proceedings and announce the court discipline;
(3) as a record in the trial process;
(four) the sorting, binding and filing of files;
(5) Complete other daily work assigned by the judge.
