Does the divorce agreement between husband and wife have legal effect?

Legal subjectivity:

The divorce agreement signed by both husband and wife is legally binding on both husband and wife as long as the contents of the agreement do not violate the law. However, before the divorce registration or the court's mediation judgment, the relationship between husband and wife is still husband and wife, and the divorce agreement has no legal effect on divorce. According to the first paragraph of Article 1065 of the Civil Code, both men and women can agree that the property acquired during the marriage relationship and the property before marriage belong to their own, * * * jointly owned or partly owned, and partly * * * jointly owned. The agreement shall be in writing. Where there is no agreement or the agreement is unclear, the provisions of Articles 1062nd and 1063rd of this Law shall apply.

Article 1076

If the husband and wife voluntarily divorce, they shall sign a written divorce agreement and apply for divorce registration in person at the marriage registration office.

The divorce agreement shall specify the expression of the will of both parties to divorce voluntarily and the consensus on matters such as child support, property and debt disposal.
